The contract that results from this bid will assist the Bureau of Health Services in its efforts to recruit experienced registered nurses who are willing to relocate from Puerto Rico to Cook County. Nurses recruited through this process will be required to enter into an employment contract to work at a Bureau facility for at least two (2) years. This contract will not only increase the pool of qualified nurses working within the Bureau, it will also increase the number of nurses with Hispanic language and cultural backgrounds. This will assist the Bureau in providing care which is sensitive to the needs of the patients, particularly as nurses perform patient assessments and interventions and provide patient education and emotional support and comfort.

The maintenance includes new and enhanced software releases, twenty-four hour problem support and resolution, bug fixes and other support. This amount also includes the purchase of additional clinical software for physician documentation and bar coding software for the safer delivery of medication for the patients.

requesting authorization to extend the existing contract, Contract No. 01-54-528 Rebid, with Jonette Products Enterprises, Ltd., Chicago, Illinois, to provide food service management at the second floor cafeteria in the Criminal Court Administration Building located at 2650 South California Avenue, Chicago, Illinois. The Cook County Board of Commissioners approved the Contract on June 5, 2001.
The Board of Commissioners authorized the Purchasing Agent to advertise for bids for a new contract on March 23, 2004. The Office of Capital Planning and Policy has indicated that this facility will be renovated in the near future. Due to the inconvenience of construction work in and around the cafeteria, it will be difficult to transition to a new food service provider at this time. Further, with the enhanced equipment and improved facilities resulting from the renovation, it is likely that bids will be higher if the process is postponed until the project is completed. The current contractor, Jonette Products Enterprises, Ltd. is willing to continue to operate the cafeteria under the terms agreed upon in June 2001, until such time renovations are complete.
Based upon the foregoing, authorization is requested to extend the contract for a period of one year, and with the option to extend for an additional period of one year if necessary, to allow for completion of the capital project.

The above purchase orders were issued for the provision of office space and support services in the Chicago downtown area to temporarily accommodate the Highway Department personnel following the October 17, 2003 fire incident at the Cook County Administration Building at 69 West Washington Street, Chicago, Illinois. The term as originally provided in the vendor agreement was for ten (10) weeks. However, the department personnel had to extend their occupancy beyond the ten (10) week period as the Cook County Administration Building was not ready for occupancy. This Ordinance has been recommended by the Department of Labor of the State of Illinois, pursuant to the Wages of Employees on Public Works (Prevailing Wage Act, Illinois Revised Statutes, codified as amended, 820 ILCS 130/1 et seq. (1193), formerly Ill. Rev. Stat., Ch. 48, par. 39s-1 et seq.).
PROPOSED ORDINANCE
WHEREAS, the State of Illinois has enacted "An Act regulating wages of laborers, mechanics and other workers employed in any public works by the State, county, city or any public body or any political subdivision or by any one under contract for public works," approved June 26, 1941, codified as amended, 820 ILCS 130/1 et seq. (1993), formerly Ill. Rev. Stat., Ch. 48, par. 39s-1 et seq.; and
WHEREAS, the aforesaid Act requires that the Board of Commissioners of the County of Cook investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other workers in the locality of said County employed in performing construction of public works, for said County.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF COMMISSIONERS OF THE COUNTY OF COOK:
Section 1. To the extent and as required by "An Act regulating wages of laborers, mechanics and other workers employed in any public works by the State, county, city or any public body or any political subdivision or by any one under contract for public works," approved June 26, 1941, as amended, the general prevailing rate of wages in this locality for laborers, mechanics and other workers engaged in the construction of public works coming under the jurisdiction of this County is hereby ascertained to be the same as the prevailing rate of wages for construction work in the Cook County area as determined by the Department of Labor of the State of Illinois as of June 2004, a copy of that determination being submitted hereto and incorporated herein by reference. As required by said Act, any and all revisions of the prevailing rate of wages by the Department of Labor of the State of Illinois shall supersede the Department's June determination and apply to any and all public works construction undertaken by the County of Cook. The Definition of any terms appearing in this Ordinance which are also used in aforesaid Act shall be the same as in said Act.
Section 2. Nothing herein contained shall be construed to apply said general prevailing rate of wages as herein ascertained to any work or employment except public works construction of this County to the extent required by the aforesaid Act.
Section 3. The Bureau of Human Resources shall publicly post or keep available for inspection by any interested party in the main office of this Bureau of Human Resources (County) this determination or any revisions of such prevailing rate of wage. A copy of this determination or of the current revised determination of prevailing rate of wages then in effect shall be attached to all contract specifications.
Section 4. The Clerk shall mail a copy of this determination to any employer, and to any association of employers and to any person or association of employees who have filed their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workers whose wages will be affected by such rates.
Section 5. The Bureau of Human Resources shall promptly file a certified copy of this Ordinance with both the Secretary of State Index Division and the Department of Labor of the State of Illinois.
Section 6. The Bureau of Human Resources shall cause to be published in a newspaper of general circulation within the area a copy of this Ordinance, and such publication shall constitute notice that the determination is effective and that this is the determination of this public body.

Section 7. The Purchasing Agent of Cook County shall specify in the call for bids in any contract for public works that the general prevailing rate of wages in the locality for each craft or type of laborer or mechanic needed to execute the contract to perform such work, also the general prevailing rate for legal holiday and overtime work as ascertained by the Bureau of Human Resources, shall be paid for each craft or type of work needed to execute the contract or to perform such work. The Purchasing Agent in awarding the contract shall cause to be inserted in the contract a stipulation to the effect that not less than the prevailing rate of wages, as found by the Bureau of Human Resources, shall be paid to all laborers, workers and mechanics performing work under the contract, and the Purchasing Agent shall also require in all such contractor's bonds that the contract include such provision as will guarantee the faithful performance of such prevailing wage clause as provided by the contract.
Section 8. In the case of any underpayment of the prevailing wage, a penalty of 20% of the underpayment shall be assessed against the contractor or subcontractor; and the 20% penalty shall be payable to the Illinois Department of Labor. Any underpayment that has not been repaid to a worker within thirty-days of violation is subject to an additional 2% of the underpayment as a punitive damage assessment. This is payable to the worker.
Section 9. There is an automatic two (2) year debarment of any contractor or subcontractor found to have violated the Act on two (2) separate occasions. An affected contractor or subcontractor may request the Department to hold a hearing on the alleged violations within ten (10) days notification of the second violation.

WIRELESS TELECOMMUNICATIONS
ORDINANCE OF COOK COUNTY, AS AMENDED (01-O-32; 02-O-24)
ARTICLE 1
WIRELESS TELECOMMUNICATIONS FACILITIES
1.0 PURPOSE
Provisions of this Ordinance are intended to address public safety concerns, promote aesthetic values and provide appropriate locations for wireless telecommunication facilities. This Ordinance establishes minimum standards for the location, installation, height and landscaping of wireless telecommunication facilities and encourages co-location of multiple service providers.
1.1 PERMITS FOR WIRELESS TELECOMMUNICATION FACILITIES
1.1.1 PERMIT REQUIREMENTS
A permit issued by the Department of Building and Zoning is required for all wireless telecommunications facilities and related accessory structures. No new or existing wireless telecommunications facility or accessory structure shall be erected, altered or relocated without first obtaining a permit.
1.1.2 PERMIT APPLICATION PROCEDURES
A. Applications for Wireless telecommunication facility permits shall be made to the Department of Building and Zoning on forms furnished by the Department. All applications shall be accompanied by a fee as established by the Cook County Board of Commissioners.
B. Applications shall include information required to assure compliance with regulations for wireless telecommunication facilities and with all other applicable ordinances and regulations of Cook County.
C. Applicants shall provide a bond, in a form acceptable to the Department of Building and Zoning, to insure that wireless telecommunication facilities will be constructed, maintained and removed in accordance with this Ordinance.
D. Applicants shall submit an agreement to remove all facilities, structures and driveways if the facility becomes technologically obsolete or ceases to perform its original function for six (6) or more consecutive months. Upon removal, the applicant shall restore the site to its original condition, less normal wear and tear, and seed all exposed soil.
E. Wireless telecommunication facility permits shall be issued by the Commissioner of Building and Zoning if the facility complies with the provisions of this Ordinance and with all other applicable ordinances and regulations of Cook County. Any permit may be revoked at any time by the Department of Building and Zoning upon a finding that a wireless telecommunication facility violates any provision of this Ordinance, of any other applicable Cook County Ordinance or when a permit holder has made false representations in securing a wireless telecommunication facility permit.

1.1.3 GENERAL REQUIREMENTS
A. Wireless telecommunication facility is defined in Article 14 of the Cook County Zoning Ordinance of 2001 under “telecommunications carrier wireless communication transmitting and receiving facility.” The terms “structure” and “building “ as used in this Ordinance are defined in Article 14 of the Cook County Zoning Ordinance of 2001. The term “public utility” as used in this Ordinance is defined in the Illinois Compiled Statutes 220 ILCS 5/3-105. “Cook County structure” includes any structure, tower or building owned or operated by Cook County or any of its agents, departments, licensees or agencies.
B. Co-location of a new wireless telecommunication facility on an existing rooftop, public utility structure, Cook County structure or other existing structure shall not exceed fifteen (15) feet above the highest point of the existing structure.
C. New wireless telecommunication facilities are permitted when co-located on an existing tower or structure, which is wholly concealed within an existing structure which is replacing an existing tower or structure.
D. New wireless telecommunication facilities more than one hundred (100) feet in height above curb level must be designed and intended for co-location of at least five (5) telecommunications service providers and must be located at least one-half (1/2) mile away from any existing wireless telecommunication facility. regardless of height.
E. New wireless telecommunication facilities shall not be installed on a building or structure less than forty (40) feet in height when located in a residential district.
F. New wireless telecommunication facilities shall be set back from the nearest residential lot line a minimum distance equal to one-half (1/2) the height of the new wireless telecommunication facility.
G. New wireless telecommunication facilities, excluding the lightning rod, shall not exceed one hundred twenty (120) feet in height above curb level or if a co-location, extend more than fifteen (15) feet above an existing public utility structure, Cook County structure or existing structure when located in a residence or commercial zoning district unless a variation is granted.
H. New wireless telecommunication facilities, excluding the lightning rod, shall not exceed one hundred fifty (150) feet in height above curb level or if a co-location, extend more than fifteen (15) feet above an existing public utility structure, Cook County structure or existing structure when located in an industrial or public zoning district unless a variation is granted.
I. New wireless telecommunication facilities shall meet or exceed the structural standards for steel antenna towers and supporting structures contained in the current “Electronic Industries Association/Telecommunications Industries Association 222 Revision Standards.”
J. New wireless telecommunication facilities proposed for forest preserve property and/or public zoning districts must be located on a portion of the site improved and used for on-site maintenance or be co-located on an existing Cook County structure.
1.2 PERMITTED FACILITIES
A wireless telecommunication facility is permitted in the following districts.
1.2.1 PERMITTED FACILITIES – RESIDENTIAL DISTRICTS
A. Wireless telecommunication facilities and related accessory structures are permitted in single-family residence zoning districts and the residential transition zoning district only where the principal use is institutional or forest preserve, a Cook County structure or a co-location on a public utility structure, subject to the provisions of this Ordinance.
B. Wireless telecommunication facilities and related accessory structures are permitted in the general residence zoning districts subject to the provisions of this Ordinance.
1.2.2 PERMITTED FACILITIES-COMMERCIAL, INDUSTRIAL AND PUBLIC DISTRICTS
A. Wireless telecommunication facilities and related accessory structures are permitted in Commercial, industrial and public zoning districts subject to the provisions of this Ordinance.
1.3 SPECIAL PROVISIONS
The following special provisions apply to wireless telecommunication facilities.
A. Wireless telecommunication facilities and related accessory structures may be located on zoning lots utilized for another use or improved with other structures or on zoning lots where no principal use or structure exists.
B. Minimum lot area, lot width and floor area ratio regulations are inapplicable to wireless telecommunication facilities and related accessory structures.

C. One off-street parking space shall be provided on site for each full time employee based upon the maximum number of employees per shift.
D. Ground, roof and pole mounted antennas shall be screened by fencing, buildings or parapets that appear to be an integral part of the building or landscaping so that no more than twenty-five (25) per cent of the combined tower structure and antenna height is visible from grade level of adjoining single family zoned property. Co-location of a new wireless telecommunication facility on an existing public utility structure or a Cook County structure is exempt from this provision.
E. Wireless telecommunication facility locations which abut a street, single family residence district or areas with public access, such as forest preserves, shall contain a landscape buffer along the property line consisting of at least one row of coniferous shrubs spaced not more than three (3) feet on center. Plant materials shall be of a variety that will grow to at least five (5) feet in height within two (2) years. Co-location of a new wireless telecommunication facility on an existing public utility structure or Cook County structure is exempt from this provision.
F. Applicants shall preserve existing vegetation on a proposed wireless facility site to the greatest extent possible and shall not remove any trees exceeding four (4) inches in diameter either prior or subsequent to the issuance of a permit. Applicants shall submit a landscaping plan to the Department of Building and Zoning for the removal of trees exceeding four (4) inches in diameter.
G. Wireless telecommunication facilities shall be either a galvanized finish or painted gray above the surrounding tree line and painted green, black or similar color below the existing or landscaped treeline to blend into the natural surroundings.
H. Wireless telecommunication facilities, including anchor posts and supporting wires, and all necessary structures, shall be completely surrounded by fencing at least six (6) feet in height. The fence shall contain a locked gate at the junction of the access way and a public thoroughfare.
1.4 CONDITIONS AND RESTRICTIONS
The Zoning Board of Appeals recommend to the Board of Commissioners such conditions and restrictions upon the premises benefited by a variation as may be necessary to reduce or minimize the effect of the variation upon other properties in the neighborhood and to better carry out the general intent of this Ordinance.
1.5 ACTION BY THE COOK COUNTY BOARD OF COMMISSIONERS
A. Final action shall not be taken by the Cook County Board of Commissioners on an application for a variation until the Zoning Board of Appeals’ finding of fact and recommendations have been received.
B. Variations in excess of ten (10) percent shall be passed by a favorable vote of three-quarters (3/4) of all members of the Cook County Board of Commissioners in cases where the Zoning Board of Appeals has not recommended the variation.
C. Applications for variations shall be deemed denied if the Cook County Board of Commissioners has not taken final action within sixty (60) days of receiving the Zoning Board of Appeals’ findings and recommendations. The sixty (60) day period may be extended if a request for an extension is made by the applicant or by a Cook County Board Commissioner.
D. The Cook County Board of Commissioners may impose conditions and restrictions upon a variation in order to assure that the public health, safety and welfare is adequately protected.
1.6 ENFORCEMENT OF ORDINANCE
The Commissioner of Building and Zoning is responsible for enforcement of this Ordinance. A person, firm or corporation, and their agents, employees or contractors who violate, disobey or refuse to comply with any provision of this Ordinance shall be subject to fines, penalties and injunctive relief as provided in Article 13 of the Cook County Zoning Ordinance of 2001.

WHEREAS, on May 25, 2004, the Illinois General Assembly passed Senate Bill 2112, as amended, providing an alternative general homestead exemption to qualifying homestead property as set forth in the Illinois Property Tax Code; and
WHEREAS, this law provides, among other things, that to be subject to the alternative general homestead exemption a County must adopt an ordinance to subject itself to that provision, in lieu of the general homestead exemption.
NOW, THEREFORE, BE IT ORDAINED, pursuant to 35 ILCS 200/15-175, as amended by SB 2112 as passed by the 93rd Illinois General Assembly, the County of Cook does hereby agree to subject itself to the provisions of such section.

PROPOSED ORDINANCE AMENDMENT
REAL PROPERTY ASSESSMENT CLASSIFICATION ORDINANCE
WHEREAS, Cook County recognizes the role of the arts in increasing the quality of life for all who reside within the county, and seeks to promote the arts in all forms;
WHEREAS, fine art galleries, in their mission, activity, and character as cultural and educational entities, greatly differ from other more conventional businesses and therefore are highly susceptible to sudden and significant increases in operating costs; and
WHEREAS, the over 60 fine art galleries located in the River North Neighborhood of the City of Chicago not only add to the cultural richness of Cook County, but employ over 200 people and account for sales well over $20,000,000, and pay $1,250,000 in sales tax; and
WHEREAS, the River North Gallery District, bounded by Chicago Avenue on the North, Huron Street on the South, LaSalle Street on the East and Orleans Street on the West, is home to a high concentration of fine art galleries in a historical neighborhood; and
WHEREAS, recent increases in property taxes have forced owners of property rented to fine art galleries to increase the rent charged to the galleries; and
WHEREAS, significant increases in rent have forced owners of fine art galleries to relocate their businesses out of the River North Gallery District; and
WHEREAS, the dispersal of fine art galleries from their locations in the River North Gallery District is detrimentally affecting the character and collective value of the galleries, and is limiting the ability of the galleries to offer educational programs; and
WHEREAS, Cook County has passed an amendment to the Real Property Assessment Classification Ordinance establishing Class L real estate, subject to property tax incentives because of the landmark or contributing building significance of the building to the character of the County;

WHEREAS, in order to encourage and maintain a thriving and culturally significant River North Gallery District which, like a landmark building, benefits all residents and visitors to Cook County;
NOW, THEREFORE, the Cook County Board of Commissioners proposes the creation of Class A real estate, as defined, subject to property tax incentives, and to be added as an amendment to the Real Property Assessment Classification Ordinance (approved and adopted April 9, 2002).
FURTHERMORE, it is proposed that the various sections of the Real Property Assessment Classification Ordinance, be amended as follows:
Section 1.
(B) Definitions:
Whenever used in this Ordinance, unless otherwise defined herein:
(40) “Fine Art Gallery” means an independent, for profit, business which sells original art, not manufactured or commercially produced, and does not include picture framers, furniture shops, and fashion shops.
(41) “River North Gallery District” means the area within the City of Chicago bounded by Superior Street on the North, Huron Street on the South, Wells Street on the East, and Franklin Street on the West.
(42) “River North Neighborhood” means the area within Chicago bounded by Chicago Avenue on the North, Huron Street on the South, LaSalle Street on the East and Orleans Street on the West.
Section 2.
Insert the following language at the end of Section 2:
CLASS A: Real Estate which:
1) is owned and operated as a fine art gallery as defined by this ordinance, or
2) is rented, in part or in whole, to businesses defined as fine art galleries by this ordinance, and
3) is located within the River North Gallery District as defined by this ordinance.
Prior to filing a Class A eligibility application with the Assessor, an applicant must obtain an ordinance or resolution from the City of Chicago which expressly states that the city government:
1) has designated the River North Gallery District as a culturally significant part of the city and the property is within the boundaries of the art district; and
2) has determined that the incentive provided by Class A is necessary to maintain the role of the property within the River North Gallery District; and
3) supports and consents to the granting of the incentive.
A certified copy of the ordinance or resolution need not be filed with the Assessor at the time the Class A eligibility application is filed, but the ordinance or resolution must be filed with the assessor no later than the date an assessment appeal is filed to request the class change to Class A.
If the ordinance or resolution is not filed at the time the eligibility application is filed, the applicant shall instead, include with the eligibility application a letter from the City of Chicago confirming that a resolution or ordinance supporting the incentive has been requested.

A copy of the resolution or letter confirming that a resolution has been requested, whichever is filed with the application, will be forwarded by the Assessor’s Office to the secretary of the Cook County Board for distribution to the Commissioners from the affected districts.
The initial Class A classification shall continue for a period of ten (10) years from the date the application was completed and initially assessed.
The number of renewal periods is not limited as long as the property continues to apply and qualify for the Class A classification. The notice of intent to request renewal which is filed with the Assessor’s office will be forwarded to by the Assessor’s Office to the secretary of the Cook County Board for distribution to Commissioners from the affected districts.
The Assessor shall adopt rules consistent with the foregoing necessary to ensure proper review of all factors relevant to determine initial and continued eligibility for the benefits provided under Class A.
The Assessor shall provide by rule for the filing of triennial reassessment reports by all Class A recipients as to the continued status of the property and the type of business located at the Class A site. Failure to file such reports within the time established by the Assessor’s rules may result in loss of the incentive for the period relating to the non-filing.
Section 3.
Insert the following language at the end of Section 3.
Class A: Renewable properties: 16 % for the first 10 years and for any 10 year renewal periods; if the incentive is not renewed, 23 % in year 11 and 30% in year 12.

HOMEOWNER EXEMPTION ORDINANCE (“N.P.H.E”)
PREAMBLE
WHEREAS, the County of Cook, Illinois, is a home rule unit of local government pursuant to Article VII, Section 6(a) of the 1970 Illinois Constitution, and pursuant to the authority therein granted, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the reassessment system in the County of Cook causes a shift of the tax burden; and
WHEREAS, due to outside factors in the real estate market over the last seven years, residential property values have grown significantly faster than any other segment of the real estate market, and residential property taxpayers have seen their property tax bills and their share of the tax burden increase more rapidly than other taxpayers; and

WHEREAS, the reassessment increases and the shifting tax burden often results in homeowners receiving significant, unpredictable increases in their property tax bills, causing severe financial hardship for them; and
WHEREAS, the Cook County Board of Commissioners previously recognized this issue for mixed use residential property and Class 3 rental property by reducing the applicable assessment levels; and
WHEREAS, Illinois’ tax structure is over-reliant on property taxes to fund schools and local taxing districts and is in need of major reform; and
WHEREAS, effective July __, 2004, the 93rd General Assembly of Illinois enacted Public Act 93-___, which authorizes a county to adopt an alternative general homestead exemption, 35 ILCS 200/15-176, (“7% assessment cap”); and
WHEREAS, the 7% assessment cap would essentially limit the taxable value of the homestead property to grow at either 7% each year or the actual increase due to reassessment – whichever is lower; and
WHEREAS, the 7% assessment cap results in a taxable value that grows more predictably, allowing homeowners the peace of mind of being able to plan and anticipate their tax bills; and
WHEREAS, the 7% assessment cap provides an immediate and effective form of property tax relief available to homeowners in the County of Cook; and
WHEREAS, the 7% assessment cap is but one aspect of the effort to stop the ever increasing tax burden on the neighborhoods of Chicago and Cook County, with the long-term goal of restructuring a fairer and more predictable property tax system; and
WHEREAS, the County Board is desirous of implementing the provisions of 7% assessment cap as provided in Public Act 93-___.
NOW, THEREFORE BE IT ORDAINED, BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF COOK, ILLINOIS, PURSUANT TO PUBLIC ACT 93-XXX, THE COUNTY OF COOK DOES HEREBY SUBJECT ITSELF TO THE PROVISIONS OF 35 ILCS 200/15-176, (“7% ASSESSMENT CAP”).
ARTICLE I
ADMINISTRATION:
1.1 The Cook County Assessor shall have the authority to determine which homestead property is entitled to an annual alternative general homestead exemption by application, visual inspection, questionnaire, or other reasonable methods. Each year, at the time the assessment books are certified to the Cook County Clerk by the Cook County Board of Review, the Cook County Assessor shall furnish to the Cook County Clerk a list of properties qualified for the alternative general homestead exemption. The list shall note the base homestead value of each property to be used in the calculation of the homestead exemption for the current tax year.
1.2 The amount of the alternative general homestead exemption is the equalized assessed value of the homestead property for the current tax year, minus the adjusted homestead value, with the following exceptions:
a. The amount of the exemption shall not exceed $20,000 in equalized assessed value for any taxable year.
b. In the case of homestead property that also qualifies for the exemption under Section 15-172 of the Property Tax Code, the property is entitled to the alternative general homestead exemption limited to the amount of (i) $4,500 for tax year 2003 or (ii) $5,000 for tax year 2004 and thereafter.

1.3 For any tax year for which the Cook County Assessor determines or adjusts an initial value for base homestead value purposes, the initial value shall be subject to review by the same procedures applicable to assessed values established by the Property Tax Code, 35 ILCS 200/1 et seq., for that tax year.
1.4 The base homestead value shall remain constant, except that the Cook County Assessor may revise it under the following circumstances:
a. If the equalized assessed value of a homestead property for the current tax year is less than the previous homestead value for that property, then the equalized assessed value for the current tax year shall become the base homestead value in subsequent tax years, provided it is not based on a reduced assessed value resulting from a temporary irregularity in the subject property.
b. For any tax year in which new buildings, structures, or other improvements are constructed on the homestead property that would increase its assessed value, the Cook County Assessor shall adjust the base homestead value with due regard to the value added by the new improvements.
c. Except to sales or transfers between spouses or between a parent and a child, if the homestead property is sold or ownership is otherwise transferred after December 31, 2002, the base homestead value of the property shall be adjusted as provided in Article II subdivision (3)(b).
1.5 In the case of an apartment building owned and operated as a cooperative, or as a life care facility, that contains residential units that qualify as homestead property under Section 15-176 of the Property Tax Code, 35 ILCS 200/15-176, the maximum cumulative exemption amount attributed to the entire building or facility shall not exceed the sum of the exemptions calculated for each qualified residential unit. The cooperative association, management firm, or other person or entity that manages or controls the cooperative apartment building or life care facility shall credit the exemption attributable to each residential unit only to the apportioned tax liability of the owner or other person responsible for payment of taxes as to that unit. Any person who willfully refuses to so credit the exemption is guilty of a Class B misdemeanor.
1.6 When married persons maintain separate residences, the homestead exemption provided under Section 15-176 of the Property Tax Code, 35 ILCS 200/15-176, shall be claimed by only one such person and for only one residence
1.7 In the event the homestead property is sold or ownership otherwise transferred after December 31, 2002, other than sale or transfers between spouses or between a parent or child, the homestead exemption provided under Section 15-176 of the Property Tax Code, 35 ILCS 200/15-176, shall remain in effect for the remainder of the tax year in which the sale or transfer occurs, but shall be calculated using the new base homestead value as provided in Article II subdivision (3)(b). The Cook County Assessor may require the new owner of the homestead property to apply for the exemption in the following year
1.8 The provisions of the homestead exemption as provided under Section 15-176 of the Property Tax Code apply as follows:
a. If the general assessment year for the homestead property is 2003, this exemption applies for assessment years 2003, 2004, and 2005. Thereafter, the provisions of Section 15-175 of the Property Tax Code, 35 ILCS 200/15-175, apply.
b. If the general assessment year for the homestead property is 2004, this exemption applies for assessment years 2004, 2005, and 2006. Thereafter, the provisions of Section 15-175 of the Property Tax Code, 35 ILCS 200/15-175, apply.
c. If the general assessment year for the homestead property is 2005, this exemption applies for assessment years 2004, 2005, and 2006. Thereafter, the provisions of Section 15-175 of the Property Tax Code, 35 ILCS 200/15-175, apply.

ARTICLE II
APPLYING THE EXEMPTION:
2.1 The Cook County Assessor shall provide to the Cook County Clerk the information necessary to calculate the 7% assessment cap homestead exemption in accordance with this Ordinance.
2.2 The Cook County Clerk shall have the authority to compute tax rates, to remove the 7% assessment cap homestead exemption value from the calculation of the property tax bill and to provide this information to the Cook County Treasurer to implement the provisions of this Ordinance.
2.3 The Cook County Treasurer shall state on the property tax bill the amount of taxes saved by the 7% assessment cap homestead exemption.
ARTICLE III
The Cook County Assessor shall produce a report for the Cook County Board of Commissioners detailing how the over-reliance on property taxes to fund education and taxing districts and the shifting tax burden impacts the property tax system.
ARTICLE IV
This Ordinance takes effect upon becoming law.

WHEREAS, in his position as Deputy Assessor of Office Administration and Taxpayer Services for the last nine and a half years, Terry has served as a spokesman before the County Board and as a liaison between the Commissioners and the Assessor’s Office; and
WHEREAS, with his diligence and professionalism, Terry has earned the respect of all who have had the good fortune of working with him; and
WHEREAS, Terry has always exhibited a deep concern for getting the facts and delivering clear and accurate information while maintaining his characteristic easy going, relaxed manner even under pressure; and
WHEREAS, the needs of the Assessor’s Office and the taxpayers served by it were always his number one priority, particularly on issues concerning budgetary needs; and
WHEREAS, Terry continued the dedication to taxpayers he initially exhibited in his tenure as State Representative by continually working to improve services for Cook County taxpayers and setting high standards for work and professionalism within the Assessor’s Office.

WHEREAS, the Cook County Integrated Criminal Justice Resolution, Agenda Item #79, dated April 23, 2002, established the Cook County Integrated Criminal Justice Information Systems (CCICJIS) Committee; and
WHEREAS, the CCICJIS Committee was comprised of the major criminal justice stakeholders of Cook County and the State of Illinois; and
WHEREAS, the Committee was charged with the development of a high-level strategic plan for an integrated criminal justice information enterprise for Cook County; and
WHEREAS, the CCIJIS Strategic Plan was submitted to the Cook County Board of Commissioner May 1, 2003; and
WHEREAS, the CCICJIS Strategic Plan detailed the eight strategic issues of Governance, Data Custodianship, Integration, Privacy, Standards, Infrastructure, Biometrics, and Funding, all which have a direct impact on the development of an integrated criminal justice enterprise for Cook County; and
WHEREAS, the recommended next step in realizing the goals of an integrated criminal justice enterprise for Cook County is to proceed with the development of a Detailed Plan of Action, which will draw upon the eight strategic issues and associated recommendations.
NOW, THEREFORE, BE IT RESOLVED, by the Cook County Board of Commissioners as follows:
I. COOK COUNTY INTEGRATED CRIMINAL JUSTICE INFORMATION SYSTEMS COMMITTEE
The Cook County Integrated Criminal Justice Information Systems Committee is hereby recast.
II. COMPOSITION OF THE COMMITTEE
A. The Committee shall be comprised of the following elected or appointed officers:
(a) The Clerk of the Circuit Court of Cook County;
(b) The Chief Judge of the Circuit Court of Cook County;
(c) The Cook County State’s Attorney;
(d) The Cook County Sheriff;
(e) The Cook County Public Defender;
(f) The Chairman of the Judicial Advisory Council;
(g) The Chairman of the Criminal Justice Coordinating Council;
(h) The Chief of the Bureau of Public Safety and Judicial Coordination;
(i) The Chief Probation Officer of the Cook County Adult Probation Department;
(j) The CIO of the Bureau of Information Technology and Automation;
(k) The Executive Director of the Cook County Department of Corrections;
(l) The Director of Cook County Emergency Management Agency;
(m) The Chief of Police for the Cook County Sheriff’s Office; and
(n) The Chief of the Cook County Forest Preserve District Police.
The following State of Illinois agencies shall each be invited to designate a representative:

(b) The Illinois Attorney General;
(c) The Illinois State Police;
(d) The Illinois Criminal Justice Information Authority;

The following law enforcement and local agencies shall each be invited to designate a representative:
(a) The Chicago Police Department;

(d) The Fifth District Police Chiefs Association (District 5);
(e) The South Suburban Police Chiefs Association (District 6); and
(f) The Chicago Crime Commission.
Lastly, to ensure input from the citizens of Cook County, the Cook County Board President shall appoint, from the general public, a seven (7) member Citizens Advisory Committee to provide the CCICJIS Committee advice on community issues concerning integration. It is recommended, but not required, for members of the Citizens Advisory Committee to have knowledge in the area of information technology and finance.
B. The Committee shall seek the input, assistance and participation of other governmental agencies, private and public interest groups as necessary or appropriate.
C. The Clerk of the Circuit Court of Cook County shall serve as Chair of the Committee and may establish ad hoc committees or subcommittees as necessary to assist the Committee in completion of its mission.
III. DUITES OF THE COMMITTEE
A. To develop a Detailed Plan of Action (specific goals, objectives, metrics and timetables) for implementing an integrated criminal justice enterprise for Cook County that includes, but is not limited to the following:
• Completing the Data Exchange Pints documentation, developed as a part of the CCICJIS Strategic Plan, to allow for inclusion of all Cook County municipalities and defining the processes and events that trigger exchange of information between the municipalities and other justice agencies.
• Developing a clear vision of the ‘to be’ or ‘future’ Cook County integrated criminal justice enterprise, with specific tasks and projects outlined to achieve this vision.
• Documenting current criminal justice interagency business processes and developing recommendations for future business process improvements which will facilitate achieving the goals of a Cook County integrated criminal justice enterprise.
• Creating the minimum requirements necessary for agencies to share information electronically, support evolving technologies, and ensure appropriate planning and maintenance of the IT infrastructure of criminal justice agencies.
• Addressing the expanding use of biometrics for rapid identification by supporting technological applications, and applicable biometric standards for criminal justice use.
• Developing a Cook County Information Privacy Policy that highlights the appropriate uses of collected, accessed and disseminated criminal justice information.
• Identifying federal, state and other sources of funding assistance to finance the integration and improving of the criminal justice information systems in Cook County.
• Ensuring that the Detailed Plan of Action complies with national and state integrated criminal justice standards.
• Developing applicable security, verification and audit functions to ensure accuracy and integrity at every point of the process.

• Identifying and with requisite approval, completing near-term opportunities/projects for improved integration between Cook County justice agencies, and with local and state agencies.

C. To report the Committee’s activities, every six (6) months, to the Cook County Board President and Board of Commissioners. The first report shall be due six (6) months from the effective date of this resolution.

Re: Rosehall Investments, Inc.
Resolution Approving Class 6b Special Exception to Abandonment
Respectfully submitting this Resolution regarding the Company’s application for Class 6b property tax incentive for your consideration.
Rosehall Investments, Inc. requests approval of the special exception to the 24 month abandonment rule under the Class 6b Ordinance. This Resolution is required so that the company can complete its application to the Assessor of Cook County.
Submitting the company application for Class 6b, the Resolution and report of the Village of Schaumburg, Illinois, and a Department of Planning and Development staff report for your information.
PROPOSED RESOLUTION
WHEREAS, the Cook County Board of Commissioners has adopted a Real Property Assessment Classification 6b that provides and applicant a reduction in the assessment level for an industrial facility; and
WHEREAS, the County Board of Commissioners has received and reviewed an application from Rosehall Investments, Inc. and the Resolution from the Village of Schaumburg for an abandoned industrial facility located at 2324 Palmer Drive, Schaumburg, Cook County, Illinois, Property Index Number 02-33-401-015-0000; and
WHEREAS, Class 6b requires the validation by the County Board of the shortened period of qualifying abandonment in cases where the industrial facility has been abandoned for less than 24 consecutive months upon purchase; and
WHEREAS, the Cook County Board of Commissioners has determined that the building was abandoned for 16 months at the time of application, and that special circumstances are present.
NOW, THEREFORE, BE IT RESOLVED, by the President and Board of Commissioners of the County of Cook, State of Illinois, that the President and Board of Commissioners indicate their approval for the filing of an application for a Cook County Real Estate Classification 6b abatement incentive to the company for an abandoned industrial facility located at 2324 Palmer Drive, Schaumburg, Cook County, Illinois, under the provision for abandonment of less than 24 months; and
BE IT FURTHER RESOLVED, that the County Clerk is hereby authorized and directed to forward a certified copy of this resolution to the Office of the Cook County Assessor.
