I respectfully request the appointment of the law firm of Vedder, Price, Kaufman and Kammholz, Chicago, Illinois, as one of the law firms to negotiate on behalf of the County with employee collective bargaining units.  The County, this year, will be in continuing negotiations with a majority of collective bargaining units representing County employees.  These negotiations involve 44 separate bargaining unit agreements requiring individual negotiations.

 

The term of this appointment will be from September 4, 2004 through November 30, 2005.

requesting authorization to a grant from the Illinois Department of Human Services (IDHS), for the Supplemental Nutrition Program for Women, Infants and Children (WIC), Problem Pregnancies, and Family Planning Services.

 

The Supplemental Nutrition Program for Women, Infants and Children (WIC) grant is to provide health screening, supplemental food certification, food prescription and nutrition counseling services to women, infants, and children.  The grant award is in the amount of $575,500.00.

 

The Problem Pregnancies grant to provide a comprehensive array of services to assist women with problem pregnancies.  The grant award is in the amount of $7,400.00.

 

The Family Planning Services affords women the opportunity to voluntarily choose a method of birth controls.  The grant award is in the amount of $601,700.00.

requesting authorization to accept an increase in the amount of $301,305.00 and extend from November 3, 2004 through March 31, 2006 grant from the Illinois State Board of Elections.  This Election Assistance to Individuals with Disabilities Grant [(Title II, Section 261, Help America Vote Act (HAVA)] is for the purpose of providing materials and services to disabled voters in suburban Cook County.  Specifically, it is for:  (1) making polling places more accessible, (2) creating materials for disabled voters, and (3) training election judges about the special needs of disabled voters.  This increase will bring the total grant award t $476,095.00.

ITEM #19

Kevin Givens, Director, Department of Environmental Control

 

requesting authorization to accept a grant award renewal in the amount of $300,280.00 from the United States Environmental Protection Agency (USEPA).  The purpose of this grant is to provide supplemental funding for the continued operation and maintenance of specialized air pollution monitoring in Cook County sites pursuant to the Illinois Environmental Protection Agency Air Monitoring Plan for 2004 - 2005.  These sites measure the 2.5 micron-sized particles suspended in the air as part of a new requirement from the USEPA and are part of a special research project to determine the quantity and composition of these very small particles in the urban air.

 

The authorization to apply for this grant was given on April 20, 2004 by the Cook County Board of Commissioners in the amount of $300,280.00.

ITEM #20

TIMOTHY C. EVANS, Chief Judge, Circuit Court of Cook County

 

requesting authorization to renew a grant in the amount of $223,297.00 from the Illinois Department of Human Services (IDHS).  This grant will fund the program in the Adult Probation Department Mental Health Unit that provides intensive supervision and coordinates treatment services for probationers who have learning and mental disabilities.  The program is designed to ensure these probationers receive maximum opportunities for successful completion of probation and placement in the community.

 

The previous grant expired in conjunction with the end of the state’s fiscal year on June 30, 2004.  This longstanding program has been funded annually by IDHS.  Funds will be used for salaries and fringe benefits for three staff probation officers assigned to the Mental Health Unit.

 

The authorization to accept the previous grant was given on September 4, 2003 by the Cook County Board of Commissioners in the amount of $184,006.00.

requesting authorization to renew a grant in the amount of $10,780,100.00 and a supplemental agreement in the amount of $1,800,000.00 from the Illinois Department of Human Services (IDHS) and the Illinois Department of Public Aid (IDPA) to continue services for an array of programs and services administered by the Division of Community Health and Prevention, Illinois Department of Human Services to include Birth to Three Assurance Network, Family Case Management, Family Planning Services, Healthy Child Care Illinois, Healthy Families Illinois, Problem Pregnancies, Supplemental Nutrition Program for Women, Infants and Children (WIC), Targeted Intensive Prenatal Case Management, Teen Parent Services and Teen Pregnancy Prevention.  The supplemental agreement will be used to enhance case management services and assist in KidCare applications.

ITEM #27

DENNIS MANZKE, Chief of the Administrative Services Bureau, State’s Attorney’s Office

 

requesting authorization to accept a grant award renewal in the amount of $39,100.00 from the Illinois Department of Children and Family Services (IDCFS).  This grant will provide continued partial funding for the Child Sexual Abuse Specialist Program that is jointly funded by the Department of Children and Family Services and the Illinois Attorney General’s Office. The one (1) full-time child sexual abuse specialist funded by this grant focuses on providing victim services including crisis intervention with victims and families of victims, identifying and making referrals for immediate and long-term counseling services, monitoring and coordinating services for children who are wards of the state and working with the local and state agencies involved with the victim as well as working directly with local and state law enforcement and service agencies to provide training, technical assistance and consultation.

 

The authorization to apply for this grant was given on July 13, 2004 by the Cook County Board of Commissioners in the amount of $40,000.00.

ITEM #28

 

Transmitting a Communication, dated August 2, 2004 from

 

DENNIS MANZKE, Chief of the Administrative Services Bureau, State’s Attorney’s Office

 

requesting authorization to renew a grant in the amount of $2,700,000.00 from the Office of the State‘s Attorneys Appellate Prosecutor of the State of Illinois.  This second year of funding will enable the State’s Attorney’s Office to continue to staff a total of forty-two (42) positions which were created in the first year of funding to staff the Criminal Appeals Division at a level that better balanced staffing between defense attorneys working on criminal appeals in Cook County and the number of assistant state’s attorneys responding to those briefs.  Specifically, this grant funds thirty-seven (37) assistant state’s attorney positions and five (5) support positions dedicated to the Criminal Appeals Division.

requesting authorization for the Purchasing Agent to enter into a contract with Lexis-Nexis, a Division of Reed Elsvier, Inc., Dayton, Ohio, for online legal research services for Cook County.  This request is made on behalf of all seventeen (17) Cook County departments and agencies that use these services as set forth on the submitted schedule.  Lexis-Nexis currently provides these services to Cook County under Contract No. 01-41-491, which expires January 31, 2005.  (See related Item #72).

 

Reason:

For the past several months, a committee comprising representatives from the Office of the Chief Judge, the Office of the State’s Attorney, the Office of the Public Defender, and the Bureau of Information Technology and Automation evaluated proposals submitted by both Lexis-Nexis and Westlaw.  These proposals were submitted in response to a Request for Proposals (RFPs) issued by the committee.  This committee unanimously recommends that the County maintain its relationship with Lexis-Nexis for online legal research services.  The committee’s recommendation is based on several factors, which include lower pricing, significant price discounts on hard copy publications, the high quality of service provided by Lexis-Nexis over the past several years, and the Lexis-Nexis commitment to customized services.

 

The proposed contract provides unlimited access to the most frequently used research libraries, unlimited training support, printing, cite checking and customized services, as well as expanded use of investigatory tools.  The fixed price for these services is $38,500.00 per month, or $1,386,000.00 for the three year period for all seventeen (17) departments and agencies listed on the submitted schedule.  The contract proposal also significantly increases the percentage of discount the County currently receives on book publications.  Overall, measured against the County’s current annual billings from Lexis-Nexis of approximately $960,000.00 for on-line services and hard copy publications, this proposed contract will save approximately $610,000.00, for the three-year contract period.

(ChoicePoint), Boca Raton, Florida, for online investigative research services for Cook County.  This request is made on behalf of the four (4) County agencies that must contact or locate missing individuals or those difficult to find in the course of official County business:  the State’s Attorney’s Office, the Office of the Public Defender, the Sheriff’s Office and the Sheriff’s Chicago High Intensity Drug Trafficking Area (HIDTA).  Presently, the County does not have a contract with ChoicePoint.  (See related Item #65).

 

Reason:

During the past year, representatives from the Office of the Chief Judge, the Office of the State’s Attorney, the Office of the Public Defender, and the Bureau of Information Technology and Automation issued a Request for Proposals (RFPs) and evaluated submissions from vendors for on-line legal research services including investigative services.  The committee has unanimously recommended that the County renew its contract with Lexis-Nexis, Inc. for online legal research services.  During this evaluation process, the committee also concluded that the market for online investigative research services has vastly expanded and improved in the past three years.  The committee determined that ChoicePoint offers comprehensive information that effectively meets the needs of County investigators.  Consequently, the committee unanimously recommended that the County enter into a contract with ChoicePoint to supplement its online investigative research services.

 

The committee’s recommendation of ChoicePoint is based on several key factors, which, include its large and comprehensive database of public records, County investigators satisfaction with this service, and the cost savings that will be provided to the County.  ChoicePoint is recognized as one of the premier public record database companies in the nation.  The proposed contract provides for unlimited access for up to 100 users to over 17 billion public records, training and technical support.  The fixed price for these services is $3,100.00 per month or $37,200.00 for one year beginning December 1, 2004.

 

The committee has determined that the State’s Attorney’s Office, the Public Defender’s Office, and Sheriff’s Chicago HIDTA have spent on average approximately $62,000.00 a year to utilize ChoicePoint’s online investigative research services.  Consequently, this proposed contract will save the County approximately $24,500.00 a year while allowing investigators from the Sheriff’s Office to use the service for the first time.

Mr. Rycyzyn has over 31 years of experience in election administration.  He served for 11 years as the Director of Elections for the Cook County Clerk’s Office.  Previous to that he served for 6 years as the Deputy Director of Elections and served in various supervisory positions prior to being named director.

 

 

Mr. Rycyzyn will assist with all aspects of election administration with special attention to ballot layout and changes to ballot equipment.  He will advise the election department on implementation of procedural changes necessary to comply with new federal and state laws.  He will also advise and assist on intergovernmental activities and projects.  The current contract expires on December 31, 2004.

Re:       HOME Investment Partnerships Program (HOME Program)

 

respectfully request approval of a HOME Investment Partnerships Program grant to be used for the rehabilitation of approximately 17 single-family homes for low and very low-income households in the following municipalities:  Calumet City, Calumet Park, Dixmoor, Ford Heights, Lansing, Park Forest, Phoenix, and Riverdale.  The project complies with the HOME Program regulations and furthers the goals of the Five-Year Consolidated Community Development Plan (approved by the U.S. Department of Housing and Urban Development on October 17, 2000).

 

The HOME Program grant of $600,000.00 will be made to Regional Redevelopment Corporation (RRC).  Approval of this grant will enable RRC to continue their Owner-occupied Single-family Rehabilitation Program.  Funds are provided to home owners through a deferred loan to rehabilitate their properties.  Permanent liens are placed on the properties for the amount of the rehabilitation by Chicago Southland Development, Inc.  After rehabilitation is completed, RRC then assigns the Note, Owner’s Participation Agreement, and Junior Mortgage to Cook County.  The Cook County HOME Program will recapture funds expended on the projects when these homes are sold, transferred, or otherwise alienated and title is transferred.

 

I respectfully request approval of this project, and that the Chief Administrative Officer of the County of Cook, or his designee, be authorized to execute on behalf of the County of Cook, any and all documents necessary to further the project approved herein, including, but not limited to the Subgrantee Agreement and any modifications thereto.

 

Estimated Fiscal Impact:  None.  Grant Funds:  $600,000.00 [$400,000.00 - (772-298 Account); and $200,000.00 - (772-292 Account)].

PRESIDENT'S OFFICE OF EMPLOYMENT AND TRAINING

Funding for this project is being provided by the Illinois Department of Commerce and Economic Opportunity (IDCEO) from the Critical Skills Shortages Initiative (CSSI).  If awarded, these funds will be used to implement programs and services for participants in high growth occupational areas in the Health Care industry.  Planned program components include the development of additional programs in high demand Health Care fields at the Community College level as well as Bridge Programs which assist students in transitioning into such programs with multiple support systems.

 

There are no matching funds required for this grant.

 

The Budget Department has reviewed this item, and all requisite documents have been submitted.

WHEREAS, the Board of Commissioners of the County of Cook finds that provision of public services by private sector employees can be cost-effective;

WHEREAS, in order to ensure that citizens of this Cook County receive high quality public services at low cost with due regard for the needs of public and private workers, the Board of Commissioners of the County of Cook finds it necessary to judiciously implement and carefully monitor such privatization contracts; and

 

WHEREAS, the Board of Commissioners of the County of Cook also finds it necessary to protect those workers who report conditions and practices which impact on the efficiency and quality of public services provided by private contractors; and

 

WHEREAS, the Board of Commissioners of the County of Cook further finds it necessary to ensure that service provision by private contractors does not in any way hinder public access to information guaranteed by the State of Illinois’ Freedom of Information Act.

 

NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF COMMISSIONERS OF THE COUNTY OF COOK:

 

SECTION 1. SHORT TITLE.

 

            This Ordinance shall be known as the “Public Services Accountability Ordinance

 

SECTION 2. DEFINITIONS.

 

For purposes of this ordinance:

 

            (1) “Board” means the Board of Commissioners of the County of Cook.

 

            (2) “County” means the County of Cook, Illinois and includes any executive office, department, divisions, boards, commissions or other offices or officers in the executive branch of the governmental unit known as the County of Cook.

 

            (3) “Employee of the private contractor” includes a worker directly employed by a private contractor, as defined in this section, as well as an employee of a subcontractor or an independent contractor that provides supplies or services to a private contractor.  Such term includes former employees of a private contractor or subcontractor and former independent contractors.

 

            (4) “Discrimination or retaliation” includes a threat, intimidation, or any adverse change in an employee’s wages, benefits, or terms or conditions of employment.  In the case of a person who is not an employee of the private contractor, such term includes any adverse action taken against the person or the person’s employer, including the cancellation of or refusal to renew a contract with that person or the person’s employer.

 

            (5) “ Services” includes, with respect to a private contractor, all aspects of the provision of services provided by a private contractor pursuant to a privatization contract, or any services provided by a subcontractor of a private contractor.

 

            (6) “Person” includes an individual, institution, federal, state, county or local government entity, or any other public or private entity.

           

            (7) “Privatization contract” is an agreement or combination or series of agreements by which a non-governmental person or entity agrees with the Board or the County to provide services valued in excess of $100,000.00 which are substantially similar to and in lieu of services provided by regular County employees upon or after the effective date of this Ordinance and that result in the reduction in force of at least one permanent, classified employee.  Notwithstanding any provision of this Ordinance to the contrary, any agreement entered into prior to the effective date of this Ordinance, including any amendments or renewals of those agreements, shall not be considered a privatization contract. This Ordinance shall not apply to contracts if any of the following apply:

(a) The services are not available within the County agency or department or are of such a highly specialized or technical nature that the necessary knowledge, skills, or expertise is not available within the agency or department;

 

(b) The services are incidental to a contract for the purchase or lease of real or personal property;

 

(c)  There is a demonstrated need for an independent audit, review, or investigation;

 

(d)  The County is not able to provide equipment, materials, facilities, or support services in the location where the services are to be performed;

 

(e) The contract is for professional services that are typically rendered on a case-by-case or project-by-project basis, such as legal, professional engineering, structural engineering, land surveying, or architectural services, and the services are:

 

                        (i) limited to the duration of the project, normally not to exceed 2 years,    or

 

                        (ii) are provided on an intermittent basis for the duration of the contract.

 

(f) The need for services is urgent, temporary, or occasional, such that the time necessary to hire and train employees would render obtaining the services from County employees impracticable.  The contract for urgent, temporary, or occasional services shall be limited to 90 days' duration, with any extension subject to review and approval;

 

(g) Efforts to recruit County employees to perform work authorized by law have failed because no applicant meeting the minimum qualifications has applied for the job;          

 

(h)  The contract is for services of private counsel;

 

(i)  The  contract  is  for  services for training courses  that  cannot  be  provided  by  current  County employees;

 

(j)  There is a conflict of interest; or

 

(k)   The County entered into the agreement prior to the effective date of  this  Ordinance,  including  any agreement resulting  from  a  re-bidding  or  previously  privatized service or an agreement renewing or extending a privatization contract.

 

(8) “Private contractor” refers to any entity which enters into a privatization contract as that term is defined in this section.

 

            (9) “Public employee” refers to an employee of any County department or agency.

 

            (10) “Public Record” refers to a public record as defined in the Illinois Freedom of Information Act and also includes any document relating to the privatization contract or performance under the privatization contract which is prepared, received or retained by a contractor or subcontractor whether such document be handwritten, typed, tape-recorded, printed, photocopied, photographed or recorded by any other method.

 

            (11) “Subcontractor” means a subcontractor of a private contractor for work under a privatization contract or an amendment to a privatization contract.

 

SECTION 3. PRIVATIZATION CONTRACTS; REQUIREMENTS.

 

a. Generally.  Neither the Board nor the County shall enter into any privatization contract and no such contract shall be valid unless the County and the contractor comply with the requirements of this Ordinance, including listing those specified provisions in the privatization contract.

b. Statement of services; analysis of bids for privatization contract.  The Board or County shall prepare a written statement of the services proposed to be the subject of the privatization contract, including the specific quantity and standard of quality of the subject services.  The Board or County shall solicit competitive sealed bids for the privatization contracts based upon this statement. The day designated by the Board or County upon which it will accept these sealed bids shall be the same for any and all parties.  This statement shall be a public record, shall be filed by the Board or County.

 

c. Disclosure. Every bid shall detail:

 

1) the length of continuous employment of current employees with the contractor by job classification without identifying employee names.  If the positions identified by the bidder shall be newly created, the bid shall identify the minimum requirements for prospective applicants for each such position;

 

2) the annual rate of current staff turnover;

 

3) the number of hours of training planned for each employee in subject matters directly related to providing service to residents of the County of Cook;

 

4) any legal complaints issued by an enforcement agency for alleged violation of applicable federal, state or local rules, regulations or laws, including laws governing employee safety and health, labor relations and other employment requirements, and any citations, court findings or administrative findings for violations of such federal, state or local rules, regulations or laws.  The information must include the date, enforcement agency, the rule, law or regulation cited, the disposition of the complaint and all subsequent remedial measures taken.

 

5) collective bargaining agreements or personnel policies covering the employees that will provide services to the County; and

 

6) political contributions made by the bidder or any employee in a management position with the bidding company to any elected officer of the Board or County during the four years prior to the due date of the bid.

 

d. Maintenance of Wage Standards.  For each position in which a contractor will employ any person pursuant to the privatization contract, the minimum compensation to be paid for such position shall be the greater of the wage rate paid at step one of the grade or classification under which a County employee whose duties are most similar is paid, plus the cash value of health and other benefits provided to such County employees, or the average private sector compensation rate, including the value of health and other benefits, for said position as determined by the Position Classification Agency of the County.

 

e. Term. The term of any privatization contract shall not exceed two years.  No amendment to a privatization contract shall be valid if it has the purpose or effect of avoiding any requirement of any section of this Ordinance.

 

f. Every privatization contract shall contain provisions requiring the contractor to offer available employee positions pursuant to the contract to qualified regular employees of the County whose County employment is terminated because of the privatization contract.  Every such contract shall contain provisions requiring the contractor to comply with a policy of nondiscrimination and equal opportunity for all persons and to take affirmative steps to provide such equal opportunity for all such persons.

 

g. Background check.  Every employee of a contractor or subcontractor authorized to provide services by the Board or County shall be subject to a criminal background check in the same manner and form as are County employees.

 

h. Drug testing.  Employees of a contractor or subcontractor shall be subject to random drug testing paid by the contractor or subcontractor and such testing shall be in the same manner and form as drug testing required of County employees.

i. Union neutrality. A contractor or subcontractor shall not use County funds to support or oppose unionization, including but not limited to, preparation and distribution of materials which advocate for or against unionization; hiring or consulting legal counsel or other consultants to advise the contractor about how to assist, promote or deter union organizing or how to impede a union which represents the contractor’s employees from fulfilling its representational responsibilities; holding meetings to influence employees about unionization; planning or conducting activities by supervisors to assist, promote, or deter union activities; or defending against unfair labor practice charges brought by federal or state enforcement agencies.

 

SECTION 4. REVIEW OF CONTRACT COSTS

 

a. Estimate of costs.  Prior to considering whether to enter into a privatization contract, the Board or County shall prepare a comprehensive written estimate of the costs of regular County employees providing the subject services in the most cost-efficient manner.  The estimate shall include all direct and indirect costs of regular County employees providing the subject services, including but not limited to pension, insurance and other employee benefit costs.  For the purpose of this estimate, any employee organization may, at any time before the final day for the Board or County to receive sealed bids pursuant Section 3 b, propose amendments to any relevant collective bargaining agreement to which it is a party. Any such amendments shall take effect only if necessary to reduce the cost estimate pursuant to this paragraph below the contract cost. Such estimate shall remain confidential until after the final day for the Board and County to receive sealed bids for the privatization contract at which time the estimate shall become a public record, shall be filed in the Board or County to receive and shall be published in a newspaper of general circulation by the Board or County.

 

b. Evaluation of Contractor Performance and Costs. After soliciting and receiving bids, the Board or County shall publicly designate the bidder to which it proposes to award the privatization contract. In selecting a contractor, the Board or County shall consider the contractor’s past performance and its record of compliance with federal, state and local laws, including the disclosures as required in Section 3 c. The Board or County shall prepare a comprehensive written analysis of the contract cost based upon the designated bid, specifically including the costs of transition from public to private operation, of additional unemployment and retirement benefits, if any, and of monitoring and otherwise administering contract performance. If the designated bidder proposes to perform any or all of the contract outside the boundaries of Cook County, said contract cost shall be increased by the amount of income tax revenue, if any, which will be lost to the County by the corresponding elimination of County employees, as determined by the Board or County to the extent that it is able to do so.

 

c. Board or County Certification.   The President of the Board of Commissioners of the County of Cook, or his/her, designee shall certify in writing:

 

            1) he/she has complied with all provisions of this section and of all other applicable laws;

 

            2) the quality of the services to be provided by the designated bidder is likely to satisfy the quality requirements of the statement prepared pursuant to Section 3 b, and to equal or exceed the quality of services which could be provided by regular County employees.

 

            3) the contract cost will be at least 10% less than the estimated cost pursuant to Section 4a, taking into account all comparable types of costs and all additional types of costs of the contract as specified in Section 4b;

 

            4) the proposed privatization contract is in the public interest in that it meets the    applicable quality and fiscal standards set forth herein.

 

Any privatization contract entered into by the Board or County and the board or county certification described above shall be public records subject to disclosure pursuant to the state Freedom of Information Act.

SECTION 5. MONITORING AND ENFORCEMENT OF PRIVATIZATION CONTRACTS.

 

a. Subcontract, Amendments to Privatization Contracts.

 

            1) No contractor shall award a subcontract for work under a contract or for work under an amendment to a contract without the approval of the President of the Board or county head or his/her designee of:

 

                        a) the selection of the subcontractor; and

 

                        b) the provisions of the subcontract.

 

            2) Each such contractor shall file a copy of each executed subcontract or amendment to the subcontract with the agency, who shall maintain the subcontract or amendment as a public record, as defined in the Freedom of Information Act.

 

b. Submission of Audits.  Any private contractor awarded a privatization contract, and any subcontractor to a private contractor subject to these provisions, shall file with the Board or County copies of financial audits of the private contractor prepared at least annually during the course of the contract term.

 

c. Access.  All privatization contracts shall include a contract provision specifying that in order to determine compliance with these principles as well as the contract, the private contractor shall be required to provide the Board or County, except where prohibited by federal or state laws, regulations or rules, reasonable access, through representatives of the private contractor, to facilities, records and employees that are used in conjunction with the provisions of contract services.

 

d. Performance standards.  The private contractor shall submit a report, not less than each year during the term of the privatization contract, detailing the extent to which the contractor has achieved the specific quantity and standard of quality of the subject services as specified by the Board or County pursuant to Section 3b of this Ordinance and its compliance with all federal, state and local laws including any complaints, citations, or findings issued by administrative agencies or courts.

 

e. Enforcement. The Board or County may seek contractual remedies for any violation of a privatization contract. 

 

SECTION 6. COMPLIANCE WITH FREEDOM OF INFORMATION ACT, PRIVACY PROVISIONS.

 

a. Ownership of Public Records.

 

1) No contractor or subcontractor or employee or agent of a contract or subcontractor, shall have any ownership rights or interest in any public records which the contractor, subcontractor, employee, Board or County possesses, modifies or creates pursuant to a contract subcontract or amendment to a contract or subcontract.

 

2) No contractor or subcontractor or employee or agent of a contractor or subcontractor, shall impair the integrity of any public records which the contractor, subcontractor, employee, Board or County possesses or creates.

 

3) Public records which a contractor, subcontractor, or employee or agent of a contractor or subcontractor, possesses, modifies or creates pursuant to a contract, or subcontract, shall at all times and for all purposes remain the property of the Board or County.

 

b. Public Access to information.

 

1) Any public record which the Board or County provides to a contractor or subcontractor shall be and remain a public record for purposes of the Illinois Freedom of Information Act and the enforcement provisions of that law shall apply to any failure to disclose records under this section.

2) With regard to any public record, the Board or County and the contractor or subcontractor shall have a joint and several obligation to comply with the obligations under the Freedom of Information Act, provided the determination of whether or not to disclose a particular record or type of record shall be made solely by the Board or County.

 

(3) No contractor or subcontractor, or employee or agent of a contractor or subcontractor shall disclose to the public any public records which it possesses, modifies or creates pursuant to a contract, subcontract or amendment to a contract or subcontract and which the Board or County

 

            (i) is prohibited from disclosing pursuant to County ordinance, state or federal law             in all cases; or

 

            (ii) may disclose pursuant to state or federal laws only to certain entities or           individuals or     under certain conditions; or

 

            (iii) may withhold from disclosure pursuant to state or federal law.  No provision   of this subsection shall be construed to prohibit any such contractor from disclosing such public records to any of its subcontractors to carry out the purposes of its subcontract. 

 

(4) No contractor or subcontractor, or employee or agent of a contractor or subcontractor, shall sell, market or otherwise profit from the disclosure or use of any public records which are in its possession pursuant to a contract or subcontract or amendment to a contract except as authorized in the contract, subcontract or amendment.

 

(5) Any contractor or subcontractor, or employee or agent of a contractor or subcontractor, which learns of any violation of the provisions of this section shall, no later than seven calendar days after learning of such violation, notify the President of the Board and/or his/her designee of such violation. 

 

c. Penalties.  In addition to any remedies provided under the Freedom of Information Act.

 

(1) If any person violates any provisions of Sections 6a or 6b the State’s Attorney of the County of Cook may bring an action against such person seeking

 

            (a) damages on behalf of the County for such violation; or

            (b) restitution for damages suffered by any person as a result of the violation.

           

(2) In addition to the remedies under paragraph (1), any person aggrieved by a violation of any provision of Section 6a or 6b may bring an action in any state court to recover any damages suffered as a result of such violation.

 

(3) In any action brought under paragraph (1) or (2) of this subsection, the court may

 

            (a) order disgorgement of any profits or other benefits derived as a result of a violation of any       provision of Sections 6a or 6b,

 

            (b) award punitive damages, costs and reasonable attorneys fees, and

 

            (c) order injunctive or other equitable relief.

 

SECTION 7. PROHIBITION AGAINST DISCRIMINATION OR RETALIATION FOR DISCLOSURE OF INFORMATION.

 

a. In General. No person shall retaliate or discriminate in any manner against any public employee or employee of a private contractor because that employee (or any person acting on behalf of the employee) in good faith:

 

  1. engaged in any disclosure of information relating to the services provided by a private contractor pursuant to a privatization contract;

  1. advocated on behalf of service recipients with respect to the care or services provided by the private contractor;

 

  1. initiated, cooperated, or otherwise participated in any investigation or proceeding of any governmental entity relating to the services provided pursuant to a privatization contract.

 

b. Attempts.  No person shall retaliate or discriminate in any manner against any public employee or employee of a private contractor because the employee has attempted or has an intention to engage in an action described in Section 7a.

 

c. Restrictions on reporting prohibited.  No person shall by contract, policy, or procedure prohibit or restrict any employee of a private contractor from engaging in any action for which a protection against discrimination or retaliation is provided under Section 7a.

 

d. Confidential information.  This section does not protect disclosures that would violate federal or state law or diminish or impair the rights of any person to the continued protection of confidentiality of communications provided by state or federal law.

 

e. Good faith action.  With respect to the conduct described in Section 7a. 1 an employee of a private contractor shall be considered to be acting in good faith if the employee reasonably believes that

 

  1. the information is true; and

 

  1. the information disclosed by the employee evidences a violation of any law, rule, or regulation, or of a generally recognized professional or clinical standard; or

 

  1. relates to the care, services or conditions which potentially endanger one or more recipients of service or employees employed pursuant to a privatization contract.

 

f. Confidentiality of complaints to government agencies.  The identity of an employee of a private contractor who complains in good faith to the Board or County or department or any member or employee of the Board or County about the quality of services provided by a private contractor shall remain confidential and shall not be disclosed by any person except under the knowing written consent of the employee of the private contractor and except in the case in which there is imminent danger to health or public safety or an imminent violation of criminal law.

 

g. Enforcement.

 

(1)        Private cause of action.

 

  1. Any current or former public employee of a private contractor who believes that he or she has been retaliated or discriminated against in violation of Sections 7a, 7b or 7c may file a civil action in any state court of competent jurisdiction against the person believed to have violated Sections 7a, 7b or 7c.

 

  1. If the court determines that a violation of Sections 7a, 7b or 7c has occurred, the court shall award such damages which result from the unlawful act or acts, including compensatory damages, reinstatement, reimbursement of any wages, salary, employment benefits, or other compensation denied or lost to such employee by reason of the violation, as well as punitive damages, attorneys’ fees, and costs (including expert witness fees).  The court shall award interest on the amount of damages awarded at the prevailing rate.

 

  1. The court may issue temporary, preliminary, and permanent injunctive relief restraining violations of this law, including the restraint of any withholding of the payment of wages, salary, employment benefits, or other compensation, plus interest, found by the court to be due and the restraint of any other change in the terms and conditions of employment and may award such other equitable relief as may be appropriate, including employment, reinstatement, and promotion.

 

  1. An action may be brought under this subsection not later than 2 years after the date of the last event constituting the alleged violation for which the action is brought.

(i) Notice.

 

(1)  In general.  Each private contractor shall post and keep posted, in conspicuous places on its premises where notices to employees and applicants for employment are customarily posted, a notice, to be prepared by the Cook County Contract Compliance Officer, setting forth excerpts from, or summaries of, the pertinent provisions of this Ordinance and information pertaining to the filing of a charge under this section.

              

(2) Penalty.  Any employer that willfully violates this section may be assessed by the County Contract Compliance Officer a penalty not to exceed $100 for each separate offense.

 

SECTION 8.  NONPREEMPTION

 

Nothing in this Ordinance preempts any other law, and nothing in this Ordinance shall be construed or interpreted to impair or diminish in any way the authority of any locality, municipality of subdivision to enact and enforce any law which provides equivalent or greater protections for its employees.

 

SECTION 9.  SEVERABILITY

 

The provisions of this Ordinance shall be severable, and if the application of any clause, sentence, paragraph, subdivision, section or part of this Ordinance to any person or circumstance shall be adjudged by a court of competent jurisdiction to be invalid, such judgment shall not necessarily affect, impair or validate the application of such clause, sentence, paragraph, subdivision, section or part of this act or remainder thereof, as the case may be, to any other person circumstance but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section or part thereof directly involved in the controversy in which such judgment shall be rendered.

 

SECTION 10.  EFFECTIVE DATE

 

This Ordinance shall take effect 90 days after enactment.  Section 7 shall apply to acts of retaliation or discrimination occurring on or after the first day of the first month that begins after the date of the enactment of this Ordinance.  The remaining sections shall be applicable to any privatization contract entered into after the effective date of this Ordinance.

WHEREAS, prostate cancer will take the lives of almost 30,000 men this year from all races and ethnic groups; and

 

WHEREAS, prostate cancer can be detected early through a simple blood test; and

WHEREAS, the Month of September has been designated Prostate Cancer Awareness Month.

 

NOW, THEREFORE, BE IT RESOLVED, BY THE COOK COUNTY BOARD OF COMMISSIONERS, in recognition of Prostate Cancer Awareness Month, strongly encourage all men to take care of themselves as well as their loved ones, by taking a simple blood screening that lasts less than 10 minutes and could save one's life.  The Board also encourages physicians to routinely offer prostate cancer testing to men who have a family history of prostate cancer, as they are more at-risk for the disease.  Finally, the importance of early detection cannot be overemphasized and men should not neglect their health, but rather make their health a top priority.

WHEREAS, the Federal Fair Housing Act specifically provides that housing developments may be designated as “senior only”, and

 

WHEREAS, allowing residency for non-senior citizens may constitute a violation of local zoning regulations; and

 

WHEREAS, providing for such use by non-senior citizens may constitute a violation of local zoning regulations; and

 

WHEREAS, the Housing Authority of Cook County is required to comply with local zoning codes pursuant to 310 ILCS 10/10; and

 

WHEREAS, by its actions the Housing Authority of Cook County will impede future intergovernmental cooperation and will discourage municipalities from promoting affordable housing.

WHEREAS, the Cook County Bureau of Health Services operates five out-patient pharmacies at various locations including the Ruth M. Rothstein Core Center, Provident Hospital of Cook County, Oak Forest Hospital of Cook County and two at Stroger Hospital of Cook County; and

 

WHEREAS, in 2003 the Bureau of Health Services’s pharmacies filled 2.2 million prescriptions; and

 

WHEREAS, the Cook County Bureau of Health Services must cope with a chronic shortage of pharmacists and it has become increasingly difficult to fill pharmacy positions due to a high demand in both the public and private sectors; and

 

WHEREAS, the private sector is currently experiencing rapid expansion of free-standing pharmacy outlets throughout the region which has significantly increased the number of pharmacies currently located in neighborhoods throughout Cook County; and

 

WHEREAS, this expansion is fueled, in part, by competition among three major pharmacy chains.

 

NOW, THEREFORE BE IT RESOLVED, that in an effort to control costs and develop efficient delivery of medicine to Bureau of Health Services patients the Cook County Board of Commissioners does hereby authorize the Bureau of Health Services to issue a Request for Proposals (RFPs) for the pharmacy needs of the Bureau of Health Services.

WHEREAS, the Cook County Board of Commissioners has the legal authority to authorize its departments and offices to open and maintain checking and savings accounts at various banks; and

 

WHEREAS, it is now necessary to update those persons who are authorized to be signers on the account.

 

NOW, THEREFORE BE IT RESOLVED, that the N.O.W. account #0074938901 at Seaway National Bank be updated, and

requesting approval of a resolution that updates the authorized signatories on the Pullman Bank checking account of the court’s Social Service Department.  Pursuant to the resolution, Ms. Carol Geirut, Executive Administrator, will be removed from the account, and Ms. Vanessa Whitehead, Deputy Director of Human Resources and Administration, will be added.  Mr. Jesus Reyes, Social Services Department Director, remains on the account.

 

The Social Service Department maintains the checking account for the receipt and disbursement of court-ordered fees and restitutions collected from individuals found guilty of felony, misdemeanor, traffic or ordinance offenses who are receiving post-dispositional casework services.

WHEREAS, the Cook County Board of Commissioners has determined that the building was abandoned for 22 months at the time of application and that special circumstances are present.

 

NOW, THEREFORE, BE IT RESOLVED, by the President and Board of Commissioners of the County of Cook, State of Illinois, that the President and Board of Commissioners indicate their approval for the filing of an application for a Cook County Real Estate Classification 6b abatement incentive to Broadway Property Group, LLC for an abandoned industrial facility located at located at 7750 Industrial Drive, Forest Park, Cook County, Illinois, under the provision for abandonment of less than 24 months; and
