In accordance with Section 30 of the 2003 Cook County Budget Resolution, I respectfully request that the Cook County Board of Commissioners authorize the Circuit Court of Cook County to apply for grant funding in the amount of $100,000.00 from The Robert Wood Johnson Foundation to enhance the court’s substance abuse treatment and related ancillary services for minors referred to juvenile court.

 

The Circuit Court of Cook County was one of 11 communities selected in 2002 from among 280 nationwide as a grant recipient under the foundation’s Reclaiming Futures:  Building Community Solutions to Substance Abuse and Delinquency Program.  Under this program, the foundation provided the court with two grants totaling $1.2 million for individualized substance abuse treatment and supervision for up to 450 minors annually in Chicago’s Lawndale community.  This new grant, if approved, would supplement the court’s current grant program by providing additional funds to research treatment methodologies with the goal of improving behavioral health care.

 

The effective date of the grant is not yet known, although it is tentatively scheduled to begin December 15, 2003 to December 14, 2004.

 

The grant does not require cash matching funds.  As such, the grant will have no fiscal impact on Cook County.

I respectfully request that the Cook County Board of Commissioners authorize the Circuit Court of Cook County to accept an extension for the use of grant funding from The Robert Wood Johnson Foundation to enhance the court’s substance abuse treatment and related ancillary services for minors referred to juvenile court.

 

The Circuit Court of Cook County was one of 11 communities selected in 2002 from 280 nationwide as a grant recipient under the foundation’s Reclaiming Futures:  Building Community Solutions to Substance Abuse and Delinquency.  This first year grant initiative, in the amount of $232,024.00 provides individualized substance abuse treatment and supervision for up to 450 minors annually in Chicago’s Lawndale community.  The grant was supplemented with additional funding in the amount of $1 million for a four year period ending March 31, 2007.  Due to a lengthy program start-up period, only a fraction of the first year grant funds, $44,450.00, was used before expiration of the grant on February 28, 2003.  As such, the foundation agreed to extend the use of the remaining funds for another year.

 

The grant does not require cash matching funds.  As such, the extension will have no fiscal impact on Cook County.

The Child Support Enforcement contracts are monies from the State of Illinois and the federal government that offset the cost to the County for pursuing child support payments.  The money is apportioned as follows:

PROPOSED ORDINANCE

 

NOW, PURSUANT TO THE HOME RULE AUTHORITY OF THE COUNTY OF COOK AS VESTED IN IT BY THE ILLINOIS CONSTITUTION, THERE IS HEREBY ENACTED THE FOLLOWING ORDINANCE:

 

            Section 1.  Short title; purpose.

 

This article shall be known and may be cited as the Cook County Whistleblower Reward and Protection Ordinance.

 

The purpose of the Cook County Whistleblower Reward and Protection Ordinance is to deter persons from knowingly causing or assisting in causing Cook County to pay claims that are false, fraudulent, or inflated, and to provide remedies for obtaining damages and civil penalties for Cook County when money is sought or obtained from Cook County by reason of a false claim.

 

The provisions of this article are not exclusive, and the remedies provided for in this article shall be in addition to any other remedies provided for in any other law, or available under common law, or otherwise.

 

This article shall be liberally construed and applied to promote the public interest.

            Section 2.  Definitions.  The following terms and phrases when used in this article shall have the meanings ascribed to them in this section, except when the context clearly indicates a different meaning:

 

"Bid takeoff" means the final estimate, tabulation, or worksheet prepared by the contractor in anticipation of the bid submitted, and which shall reflect the final bid price.

 

"Claim" means any invoice, statement, request, demand, lawsuit, or action, under contract or otherwise, for money, property, or services made to any employee, officer, or agent of the Cook County, or to any contractor, grantee, or other recipient if any portion of the money, property, or services requested or demanded was issued from, or was provided by, Cook County (hereinafter "Cook County funds").

 

"Claimant" means any person who brings, submits, files, maintains, or pursues a claim.

 

"Cook County" means the government of Cook County or any department, division, bureau, section, commission, planning agency, board, district, authority, agency, or instrumentality of Cook County.

 

"Extended overhead" means the amount of a claim relating to an increase in overhead costs resulting from a delay in contract performance that is not compensated by a markup of direct costs.

 

"Knowing" or "knowingly" means that a person, with respect to information:

 

Has actual knowledge of the information;

 

Acts in deliberate ignorance of the truth or falsity of the information; or

 

Acts in reckless disregard of the truth or falsity of the information, and no proof of specific intent to defraud is required.

 

"Overhead per diem" means the amount calculated by dividing the total overhead costs set forth in the final bid takeoff by the number of days for substantial completion of the work set forth in the contract.

 

"Person" means any natural person, corporation, firm, association, organization, partnership, agency, limited liability company, business, or trust.

 

            Section 3. Certification of claims.

 

Upon the request of Cook County, the person submitting a claim shall, within thirty (30) days, including Saturdays, Sundays, and legal holidays, submit a certified claim as defined by this section.  A "certified claim" shall be made under oath by a person duly authorized by the claimant, and shall contain a statement that:

 

the claim is made in good faith;

 

the claim's supporting data are accurate and complete to the best of the person's knowledge and belief;

 

the amount of the claim accurately reflects the amount that the claimant believes is due from the Cook County; and

 

the certifying person is duly authorized by the claimant to certify the claim.

 

Failure to provide the requested certification within the prescribed thirty-day (30) period shall constitute a forfeiture of the entire claim.

 

            Section 4.  Liability for Whistleblower Reward and Protection; penalties.

 

The following action(s) shall constitute a violation of this ordinance:

 

any person who knowingly presents or causes to be presented to Cook County, or to any officer, employee, agent, or consultant of Cook County, a false or fraudulent claim for payment or approval;

any person who knowingly makes, uses, or causes to be made or used, a false record or statement to get a false, fraudulent, or inflated claim paid or approved by Cook County;

 

any person who conspires to defraud Cook County by facilitating the payment of a false, fraudulent, or inflated claim allowed or paid by Cook County;

 

any person who delivers, with the intent to defraud Cook County, goods or services of different quality or quantity than that specified in the applicable contract or specification;

 

any person who is authorized to make or deliver a document certifying receipt of property used, or to be used, by Cook County and, intending to defraud the Cook County, makes or delivers the receipt without completely knowing that the information on the receipt is true;

 

any person who knowingly buys, or receives as a pledge of an obligation or debt, public property from an officer, employee, or agent of Cook County who lawfully may not sell or pledge the property; or

 

any person who knowingly makes, uses, or causes to be made or used, a false record or statement to conceal, avoid, or decrease an obligation to pay or transmit money or property to Cook County.

 

Any beneficiary of an inadvertent submission of a false claim to Cook County, who subsequently discovers the falsity of the claim, and who fails to disclose the falsity of the claim to the Cook County within thirty (30) days of discovering the error, shall also be found to have submitted a false claim to Cook County.

 

Any person found to have submitted a false claim to the Cook County shall:

 

be liable to the District for an amount equal to three times that part of the claim which is false, fraudulent, or inflated;

 

immediately, fully, and irrevocably forfeit the entire amount of the claim;

 

be liable for a civil penalty of not less than $5,000 and nor more than $10,000;

 

be liable to Cook County for all costs and fees (including, without limitation, reasonable legal, expert, and consulting fees) incurred by Cook County to review, defend, and evaluate the claim; and

 

be subject to debarment from Cook County contracting for a period not to exceed five (5) years.

 

Additionally, any person who certified a claim later found to be false shall be subject to debarment from Cook County contracting for a period not to exceed five (5) years.

 

Liability under this section shall be joint and several for any act committed by two or more persons.

 

            Section 5.  Civil actions for Whistleblower Reward and Protection.

 

The Cook County State's Attorney may investigate a violation under Section 4.  If the Cook County State's Attorney finds that a person has violated or is violating Section 4, he or she may bring a civil action against the person on behalf of the County.

 

A person may bring a civil action for a violation of Section 4 for the person and for the County.  Civil actions instituted under this ordinance shall be governed by the Illinois Rules of Civil Procedure and shall be brought in the name of Cook County.

The complaint shall be identified on its face as a qui tam action and shall be filed under seal in the circuit court of the First Judicial Circuit, in and for Cook County.  Immediately upon filing of a complaint by a person, a copy of the complaint and written disclosure of substantially all material evidence and information the person possesses shall be served on the Cook County State's Attorney by registered mail, return receipt requested.  The Cook County State's Attorney may elect to proceed with the action, in lieu of the qui tam plaintiff, on behalf of Cook County, within 60 days after he or she receives both the complaint and the material evidence and information.

 

The Cook County State's Attorney, for good cause shown, may petition the court to extend the time during which the complaint remains under seal under subsection (1).  Any such motion may be supported by affidavits or other submissions in camera.  The defendant is not required to respond to any complaint filed under this section until twenty (20) days after the complaint is unsealed and served upon the defendant in accordance with law.

 

Before the expiration of the 60-day period or any extensions obtained under subsection (2), the Cook County State's Attorney shall:

 

            proceed with the action; or

 

notify the court that Cook County declines to take over the action, in which case the person bringing the action has the right to conduct the action.

 

When a person files an action under this section, no person other than the Cook County State’s Attorney on behalf of Cook County may intervene or bring an action under this ordinance based on the facts underlying the pending action.

 

            Section 6.  Rights of the parties in civil actions.

 

If the Cook County State’s Attorney, on behalf of Cook County, elects to proceed with the action, he or she has the primary responsibility for prosecuting the action, and is not bound by any prior or subsequent act(s) of the person bringing the action. Cook County may also voluntarily dismiss the action notwithstanding the objections of the person bringing the action.

 

If the Cook County State’s Attorney elects not to proceed with the action, the person bringing the action has the right to conduct the action.  If the Cook County State’s Attorney so requests, he or she shall be served with copies of all pleadings and motions filed in the action and copies of all deposition transcripts.

 

When the person bringing the action proceeds with the claim, the court may permit Cook County to take over the action on behalf of Cook County at a later date upon a showing of good cause.

 

Nothing in this ordinance shall be construed to limit the authority of Cook County or the qui tam plaintiff, proceeding pursuant to Section 5(b), to compromise a claim brought in a complaint filed under this ordinance if the court determines, after a hearing, that the proposed settlement is fair, adequate, and reasonable under all the circumstances.

 

Whether or not the Cook County State’s Attorney proceeds with the action, upon a showing by the Cook County State’s Attorney that certain actions of discovery by the person initiating the action would interfere with the Cook County State’s Attorney's investigation or prosecution of a criminal or civil matter arising out of the same facts, the court may stay such discovery for a period of not more than 60 days. Such a showing shall be conducted in camera. The court may extend the 60-day period upon a further showing in camera that the Cook County State’s Attorney has pursued the criminal or civil investigation or proceedings with reasonable diligence and any proposed discovery in the civil action will interfere with the ongoing criminal or civil investigation or proceedings.

Notwithstanding Section 5(b), the Cook County State’s Attorney may elect to pursue its claim through any alternate remedy available to the Cook County State’s Attorney, including any administrative proceeding to determine a civil money penalty. If any such alternate remedy is pursued in another proceeding, the person initiating the action shall have the same rights in such proceeding as such person would have had if the action had continued under this section. Any finding of fact or conclusion of law made in such other proceeding that has become final shall be conclusive on all parties to an action under this section. For purposes of the preceding sentence, a finding or conclusion is final if it has been finally determined on appeal to the appropriate court of the State of Illinois, if all time for filing such an appeal with respect to the finding or conclusion has expired, or if the finding or conclusion is not subject to judicial review.

 

Section 7.  Awards to plaintiffs bringing action.

 

If Cook County proceeds with and prevails in an action brought by a person under this ordinance, except as provided in subsection (b), the court shall order the distribution to the person of at least 15 percent but not more than 25 percent of the proceeds recovered under any judgment obtained by Cook County in an action under Section 4 or of the proceeds of any settlement of the claim.

 

If Cook County proceeds with an action which the court finds to be based primarily on disclosures of specific information, other than that provided by the person initiating the action, relating to allegations or transactions in a criminal, civil, or administration hearing; a legislative, administrative, or inspector general report, hearing, audit, or investigation; or from the news media, the court may award such sums as it considers appropriate, but in no case more than 10 percent of the proceeds recovered under a judgment or received in settlement of a claim under this ordinance, taking into account the significance of the information and the role of the person bringing the action in advancing the case to litigation.

 

If Cook County does not proceed with an action under this ordinance, the person bringing the action or settling the claim shall receive an amount not less than 25 percent and not more than 30 percent of the proceeds recovered under a judgment rendered in an action under this ordinance or in settlement of a claim under this ordinance.

 

Any payment under this section to the person bringing the action shall be paid only out of the proceeds recovered from the defendant.

 

Whether or not Cook County proceeds with the action, if the court finds that the action was brought by a person who planned, initiated, or furthered the violation of Section 4 upon which the action was brought, the person shall be dismissed from the civil action and shall not receive any share of the proceeds of the action. Such dismissal shall not prejudice the right of Cook County to continue the action.

            Section 8.  Expenses; attorney's fees and costs.

 

If Cook County initiates an action under this ordinance or assumes control of an action brought by a person under this ordinance, and Cook County prevails in such action, Cook County shall be awarded its reasonable attorney's fees, expenses, and costs.

 

If the court awards the person bringing the action proceeds under this ordinance, the person shall also be awarded an amount for reasonable attorney's fees and costs.  Payment for reasonable attorney's fees and costs shall be made from the recovered proceeds before the distribution of any award.

 

If Cook County does not proceed with an action under this ordinance and the defendant is the prevailing party, the court shall award the defendant reasonable attorney's fees and costs against the person bringing the action.

 

No liability shall be incurred by Cook County for any expenses, attorney's fees, or other costs incurred by any person in bringing or defending an action under this ordinance, except as otherwise specifically provided by law.

 

Section 9.  Exemptions to civil actions.

 

In no event may a person bring an action under Section 4 based upon allegations or transactions that are the subject of a civil action or an administrative proceeding in which Cook County is already a party.

No court shall have jurisdiction over an action brought under this ordinance based upon the public disclosure of allegations or transactions in a criminal, civil, or administrative hearing; in a legislative, administrative, or inspector general report, hearing, audit, or investigation; or from the news media, unless the action is brought by Cook County, or unless the person bringing the action is an original source of the information. For purposes of this subsection, the term "original source" means an individual who has direct and independent knowledge of the information on which the allegations are based and has voluntarily provided the information to the Cook County State’ Attorney before filing an action under this ordinance based on the information.

 

            Section 10.  Protection for participating employees.

 

Any employee of Cook County who is discharged, demoted, suspended, threatened, harassed, or in any other manner discriminated against in the terms and conditions of employment by his or her employer because of lawful acts done by the employee on behalf of the employee or others in furtherance of an action under this article, including investigation for, initiation of, testimony for, or assistance in an action filed or to be filed under this article, shall be entitled to all relief necessary to make the employee whole.   Such relief shall include reinstatement with the seniority status such employee would have had but for the discrimination, two times the amount of back pay, interest on the back pay, and compensation for any special damages sustained as a result of the discrimination, including litigation costs and reasonable attorneys' fees.  An employee may bring an action in the appropriate circuit court for the relief provided in this Section.

 

Section 11.  Burden of proof; presumption of false claim.

 

Whenever practicable, bid specifications for Cook County contracts shall contain a requirement that the successful bidder maintain, as a condition precedent to submitting a claim against Cook County, a final bid takeoff.  The final bid takeoff shall contain a line item for allocation of overhead costs.

 

Upon request from Cook County, a contractor making a claim against Cook County for delay or other damages shall submit, within twenty (20) days, a copy of the final bid takeoff, certified pursuant to this subsection. Failure to provide the requested certification shall constitute a forfeiture of the claim for delay or other damages. The certification shall be submitted under oath by a person duly authorized by the claimant and shall contain a statement that:

 

the final bid takeoff was prepared contemporaneously with the bid and in anticipation of the bid for the project;

 

the contractor relied on the final bid takeoff to prepare the bid and the original schedule of values; and

 

the final bid takeoff has not been altered in any way.

 

Any claim for extended overhead costs that exceeds, on a per diem basis, more than ten percent (10%) of the overhead per diem contained in the final bid takeoff shall be presumed to be a false claim, and the contractor shall have the burden of proving that any such claim for extended overhead is not false.

 

Section 12.  Innocent claimant affirmative defense.

           

The provisions of this ordinance shall not apply if the claimant can demonstrate by a preponderance of the evidence each of the following facts:

 

the claimant submitted or caused to have submitted the claim to or against Cook County reasonably believing that such claim was free of any material misstatements, or any exaggerated, inflated, or unsubstantiated assertions or damages;

 

the claimant had no reasonable basis to doubt the truth, veracity, or accuracy of such claim at the time it was submitted;

 

prior to submitting the claim, the claimant diligently investigated the facts underlying such claim and prepared the claim in a reasonable manner given all the relevant information available; and

 

when information indicating that any element, statement, or allegation in the claim was false or misleading first became available, such claimant, within five (5) business days of discovering the falsity of the claim, took immediate steps to modify, correct, or withdraw such claim and provided Cook County with immediate notice thereof.

            Section 13.  If any section, subsection, sentence, clause, or provision of this ordinance is held invalid, the validity of the remainder of this ordinance shall not be affected by such clause.

 

            Section 14.  This ordinance shall become effective ten (10) days after the date of enactment.  Once effective, this ordinance shall apply to (1) all claims submitted to or prosecuted against Cook County after the effective date hereof, and (2) all claims pending before Cook County or any court or agency of competent jurisdiction on or after the effective date of this ordinance. As to claims described in subsection (2) of this section that were filed or submitted prior to the effective date hereof, this ordinance shall apply only to such claims after Cook County provides written notice of this ordinance to the claimant, via certified mail, and allows the claimant a grace period of twenty (20) days to bring its claim into compliance herewith. In such instances, this ordinance shall apply to such claims immediately upon the expiration of the twenty-day grace period.

 

NOW THEREFORE BE IT ORDAINED, that the Cook County Board of Commissioners elects to adopt the Cook County Whistleblower Reward and Protection Ordinance pursuant to its home rule authority as vested in it by the Illinois Constitution.  Upon approval, a copy of this ordinance shall be filed with the States Attorney’s office within ten (10) days of its passage by the Cook County Board of Commissioners.

WHEREAS, in 1853 Commodore Matthew Perry first asked Japan for an open-door invitation to foreign commerce initiating the U.S. - Japan relationship, and

 

WHEREAS, the two very diverse cultures with no prior relations bonded and the journey to strong bilateral ties and development began, and

 

WHEREAS, Commodore Perry introduced modern inventions to Japan and sparked further interest in learning about Western Civilization, resulting in the birth of modern Japan, and

 

WHEREAS, the Iwakura Mission was established in 1868 with 107 members to explore the U.S. to help build a new Japan, and

WHEREAS, today, the U.S. and Japan mutually benefit each other immensely through trade and investments, as well as in cultural and many other areas, and

WHEREAS, Bose Ijaola is thirty-two years old and resides in Chicago, Illinois; and

 

WHEREAS, Bose a former national bodybuilder competitor, started participating in boxing in the year 2000; and

 

WHEREAS, Bose was training at the Bally’s gym and was asked if she wanted to participate in the sport; and

 

WHEREAS, Bose joined the boxing program at Chicago’s Garfield Park Boxing Club which has become the premier training ground for amateur women boxers under Head Coach, George Hernandez; and

 

WHEREAS, Bose weighs one hundred and seventy-six pounds with a seventy inch reach; she has had nine fights, five by knock out, and is undefeated; and

 

WHEREAS, Bose holds the National Female Golden Gloves for 2002 and 2003 and the Chicago Golden Gloves for 2002 and 2003; and

 

WHEREAS, Bose is currently the Gold Medal Champion for the Female National USA boxing tournament that was held in Fort Lauderdale on July 11, 2003; and

 

WHEREAS, for winning the competition she was selected by the Olympic Committee to represent the USA female boxing team dual in Russia this past September; and

 

WHEREAS, unfortunately the USA female boxing team was defeated by the Russians, needless to say it was a great experience and a honor to represent the United States in such manner; and

 

WHEREAS, Bose’s quest now is to turn pro and dominate the sport in the next coming year.

 

NOW, THEREFORE, BE IT RESOLVED, that the President and Members of the Board of Commissioners, on behalf of the more than five million residents of Cook County, does hereby take this opportunity to congratulate Bose Ijaola; and

WHEREAS, Lowell Anderson was worldwide director of transportation at Amoco Chemical Corporation until his retirement in 1988, and his work developing pipelines gave him a unique opportunity to travel and live in other countries, and

 

WHEREAS, despite a busy schedule, Lowell Anderson frequently volunteered for community organizations, and he enjoyed collecting classic cars and spending time with his family, and

 

WHEREAS, Lowell Anderson made many valuable contributions to Cook County as an original member of the Board of Directors of METRA, where he utilized his expertise and knowledge to resolve suburban transportation issues, and where he served as treasurer for eighteen years, now therefore

RESOLUTION

 

WHEREAS Almighty God in His infinite wisdom has called Nancy M. Caruso from our midst, and

 

WHEREAS Nancy M. Caruso (nee Marfoe) was the beloved wife of the late Mariano “Mutt” Caruso, and

 

WHEREAS Nancy M. Caruso was the loving mother of Leo (Ruth), Francine, Charles (Karen), Joseph (Sarah) and the late Peter (Paula) Caruso, and

 

WHEREAS Nancy M. Caruso was the beloved daughter of the late Leo and Almarinda Marfoe, and

 

WHEREAS Nancy M. Caruso was the dear sister of Joseph (Florence), John (the late Grace) and the late Lawrence (Velmae) and Pasqual (Joan) Marfoe, and

 

WHEREAS Nancy M. Caruso was the fond grandmother of 13, great-grandmother of 7 and the fond aunt of many nieces and nephews, and

 

WHEREAS all who knew her will attest that Nancy M. Caruso was a kind and compassionate woman, virtuous of character and gentle in spirit, admired and respected by her many friends and neighbors, and dearly loved by her family, now therefore

 

BE IT RESOLVED by the Board of Commissioners of Cook County that the Board does hereby offer its deepest condolences and most heartfelt sympathy to the family and many friends of Nancy M. Caruso, and joins them in sorrow at this time of loss, and

 

BE IT FURTHER RESOLVED that this text be spread upon the official proceedings of this Honorable Body, and a suitable copy of same be tendered to the family of Nancy M. Caruso, that her memory may be so honored and ever cherished.

RESOLUTION

 

WHEREAS, on October 1, 2003, a devastating tragedy occurred when eight women, all members of the International Ladies Association, and all individually inspiring women, were involved in a deadly bus accident while returning from a day trip to a Japanese garden, and

 

WHEREAS, one of the eight women, Marita Landa, mother of three, wife of the late Dr. Stuart Landa, grandmother, humanitarian, and friend was taken from our midst in a blur at the very young age of sixty-six, and

 

WHEREAS, Marita Landa’s focus in life was assisting others; she received her nursing degree in Finland where she was born, and

 

WHEREAS, Marita Landa took a deep and personal interest in international affairs, she served as a member of several international societies where she worked tirelessly for the causes she believed in, and after her husband’s death she joined the Peace Corps in the late 1990s, where she labored as a health services worker in a village in West Africa, and

 

WHEREAS, Marita Landa was involved in several Scandinavian associations, such as the Finnish American Chamber of Commerce and the North Park College Scandinavian Studio Advisory Council, as well as other clubs and relationships which allowed her to explore her passion of international affairs, such as the International Ladies Association and the University of Chicago, where she was involved in locating housing for international students and also hosted many international students at her home for Christmas and Thanksgiving dinners, and

 

WHEREAS, Marita Landa was an active member of the Viking Ship Restoration Committee, a committee dedicated to preserve a ship built in Norway as a replica of an authentic Viking ship, which sailed from Norway to Chicago as an exhibit for the 1893 World’s Fair and Exposition held in Chicago, and

 

WHEREAS, Marita Landa’s energy radiated to others in every activity in which she was involved; she was known as a lovely, gracious, well-respected and fun-loving person with Grace Kelly type good looks, and

 

WHEREAS, Marita Landa’s life is a testament to love, caring and compassion, and her presence with us will remain, though not in a physical form, now therefore

 

BE IT RESOLVED, that the Cook County Board of Commissioners wishes to express its profound sorrow at the passing of this remarkable woman, and extends its condolences to the family and friends of Marita Landa in their bittersweet time of loss and remembrance, for as she will be missed, the fortune of knowing Marita Landa for even a brief period of time was invaluable.
