requesting authorization to accept a grant in the amount of $188,897.00 from the United States Department of Justice, Office of the Justice Programs.  The purpose of this grant is to prevent youth crime, violence and gang involvement, develop a positive relationship between law enforcement, families and society’s young people, create safer neighborhoods and communities and to instill a sense of competency, usefulness and personal empowerment needed to avoid involvement in youth violence, gangs and criminal activity.

 

The authorization to apply for the grant was given on July 13, 2004 by the Cook County Board of Commissioners in the amount of $188,897.00.

 

No cash matching funds are required.

requesting authorization to renew a grant in the amount of $24,046.00 for the fiscal year 2004 United States Department of Justice/Office of Justice Programs Local Law Enforcement Block Grant (LLEBG).  These funds will be used to provide for the operation of prevention programming services to at-risk youths residing in the Ford Heights community.

 

These funds require a $2,672.00 County cash match.

 

The Judicial Advisory Council is also requesting permission to receive the fiscal year 2004 funds and to use these funds to enter into a contract with the Village of a Ford Heights to expand the number of participants in their Police Athletic League and Police and Children Together programs.  These programs provide youth with opportunities to engage in positive social activities with peers and police officers that have been previously beneficial to the safety and stability of the community.

transmitting a communication reporting the reduction in grant funding which will reduce services in 2004 from the Illinois Department of Human Services (IDHS) for an array of programs and services administered by the Division of Community Health and Prevention, Illinois Department of Human Services.

 

The Illinois Department of Human Services contract submitted to the Cook County Board of Commissioners on September 8, 2004, was based on the Governor’s Fiscal Year 2005 budget.  When the fiscal year 2005 budget was passed by the legislature, funding reductions occurred in the contract from General Revenue Funds (GRF).  The IDHS contract was reduced from $10,780,100.00 to $10,474,800.00.

requesting authorization for the Purchasing Agent to enter into a contract with Heartland Human Care Services, Inc. (formerly Travelers & Immigrants Aid), Chicago, Illinois, to provide short term housing and living assistance for minors charged with delinquency petitions in juvenile court.

 

Reason:

Heartland Human Care Services, Inc. provides safe, quality care for boys and girls ages 10 to 17 who have been referred from juvenile court.  These minors are either eligible for admission to the Juvenile Temporary Detention Center (JTDC) but who qualify for placement with Heartland Human Care Services, Inc. under the Juvenile Detention Alternatives Initiative, or are residents of JTDC who have been released from detention by judicial order and whose parents or guardians will not or cannot secure their release.  From 1995 through September 30, 2004, Heartland Human Care Services, Inc. has provided such services for 8,012 minors.

 

Contract services include housing and meals, living skills instruction, counseling, recreation, transportation, 24-hour supervision, medical and psychiatric services, and referrals to community resources as needed.  Total program capacity is thirty-eight minors at two locations:  the Manuel Saura Center for Boys, located at 2732 North Kedzie Avenue in Chicago’s Logan Square community, and the Morse Home for Girls, located at 1628 West Morse Avenue in Chicago’s Rogers Park community.  More than 1,000 minors are serviced annually.

The increased funding would establish an Access to Care pilot program in the City of Chicago.  The Access to Care Program is the only program of its kind, providing primary health care to medically indigent residents of suburban Cook County through a network of physicians.  The Suburban Primary Health Care Council is a private not-for-profit consortium of the Department of Public Health (IDPH), Community and Economic Development Association of Cook County, Inc. (CEDA) and the Northwest Suburban Cook County Health Care Taskforce.  The expiration date of the current contract is December 31, 2004.

The subject property consists of that part of the Northwest Quadrant of the Eisenhower Expressway and US 45 (Mannheim Road) being an area of approximately ± 108,500 square feet (2.4908 acres) in the NE ¼ Section 17, Township 39 North, Range 12, East of the Third Principal Meridian, in Proviso Township, Cook County Illinois.

 

It has been determined by all agencies involved that the subject property is no longer needed for highway purposes and can be released for sale.

Re:       FY 2003 Actuarial Report

 

As part of the County’s external audit, the Bureau of Finance has received the final Actuarial Report from PriceWaterhouseCoopers for the worker’s compensation and self-insured liabilities for the fiscal year ended November 30, 2003.  The report estimates that the County’s total liabilities were $402.7 million, which represents a reduction in estimated losses of $46.6 million from FY 2002.  The change in loss estimate between FY 2003 and FY 2002 breaks down as follows:

Further, based upon their analysis, the County should expect to pay out $51.8 million in loss payments in FY 2005.  This amount has been included in the FY 2005 budget.

 

Also, for your information, I have submitted schedules showing the comparison of projected loss payments versus actual loss payments for FY 2003 – FY 1999.  As you can see, we have been fairly accurate in the estimates of projected versus actual losses.

PROPOSED ORDINANCE AMENDMENT

 

AN ORDINANCE TO AMEND THE

COOK COUNTY ANIMAL AND RABIES CONTROL ORDINANCE

 

WHEREAS, the County of Cook is a home rule unit of government as defined in Article VII, Section 6(a) of the 1970 Constitution of the State of Illinois, and as such may exercise any power and perform any function pertaining to its government and affairs; and

 

WHEREAS, through the Animal Control Act, 510 ILCS 5/1 et seq., the General Assembly has directed that the County Board appoint an Administrator whose duty it shall be, “through education, rabies inoculation, stray control, impoundment, quarantine, and any other means necessary, to control and prevent the spread of rabies in his county” (510 ILCS 5/5); and

 

WHEREAS, the General Assembly has specifically authorized the County to enact an ordinance establishing a fee for each dog inoculated against rabies (510 ILCS 5/8); and

 

WHEREAS, on January 3, 1977, the Board of Commissioners of Cook County adopted the “Cook County Animal and Rabies Control Ordinance” and seven accompanying administrative regulations and last amended this ordinance on January 22, 2004; and

 

WHEREAS, the Board of Commissioners desires to update the Animal Control Ordinance so that it is in conformity with subsequent changes in law and practice.

 

NOW, THEREFORE, BE IT ORDAINED, by the Board of Commissioners of Cook County that the “Cook County Animal and Rabies Control Ordinance” shall be amended as follows:

 

SECTION 1:

 

Definitions

 

20-2.    As used in this Ordinance the following words are defined:

 

            A.        Administrator means the licensed veterinarian appointed by the Board of Commissioners of Cook County, pursuant to the Illinois Animal Control Act or his authorized representative.

 

            B.         Animal means any live vertebrate creature except man.

 

            C.         Animal capable of transmitting rabies means all animals classified as mammals.

 

            D.        Animal control warden means an employee of Cook County appointed by the Administrator to exercise police powers in the enforcement of this Ordinance.

 

            E.         Bird means any flying vertebrate that is covered with feathers.

 

            F.         Bite means seizure of a person with the jaws or teeth of any cat, dog or other animal capable of transmitting rabies so that the person so seized has been wounded or pierced and further includes contact of the saliva of such cat, dog or other animal with any break or abrasion of the skin.

 

            G.         Cat means all members of the classification, Felis catus.

 

            H.        Confined means the restriction of the cat, dog or other animal at all times by the owner in a manner that will isolate the cat, dog or other animal from the public and other cats, dogs or other animals.

            I.          Control means any owned animal that is either secured by a leash or lead, or under voice control or within the premises of its owner, or confined within a crate or cage, or confined within a vehicle, or on within the premises of another person with the consent of that person.

 

            J.          Dangerous or vicious animal means any animal which has known vicious propensities or which has been known to attack or injure any person who was peacefully conducting himself in any place where he may lawfully be.

 

            K.        Dog means all members of the classification, Canis familiaris.

 

            L.         Domestic animal means any animal which has been domesticated by man so as to live and breed in a tame condition.

 

            M.        Guard dog means a dog used in a commercial business or by a municipal or police department for the purposes of patrol and protection.

 

            N.        Guide dog means a dog trained by a recognized organization to lead the legally blind Service animal means any guide dog, signal dog, or other animal individually trained to do work or perform tasks for the benefit of an individual with a disability, including, but not limited to, guiding individuals with impaired vision, alerting individuals with impaired hearing to intruders or sounds, providing minimal protection or rescue work, pulling a wheelchair, or fetching dropped items.

 

            O.        Inoculation against rabies means the injection of a rabies vaccine approved by the Illinois Department of Agriculture and administered by a licensed veterinarian in accordance with the company's recommendations for the vaccine used.

 

            P.         Owner means any person having the right of property in an animal, who keeps or harbors an animal, who has it in his care, acts as its custodian or who knowingly permits an animal to remain on or about any premises occupied by him unless possession is prohibited by Federal or State Laws.  Native wildlife remaining on or about any premises shall not be included in this definition.

 

            Q.        Person means any individual, firm, corporation, partnership, society, association or other legal entity, any public or private institution, municipal corporation, unit of local government or any other business unit.

 

            R.         Pound means any facility licensed by the Illinois Department of Agriculture and approved by the Administrator for the purpose of enforcing this Ordinance and used as a shelter for seized, stray, homeless, abandoned or unwanted animals.

 

            S.         Stray animal means any owned animal that is not controlled.

 

            T.         Voice control means the immediate recall of a dog at the sound of the voice of the owner.

 

SECTION 2:

 

Animal Care

 

20-3.    A.  No owner shall fail to provide his animals with sufficient wholesome food and water, proper shelter and protection from the weather, veterinary care when needed to prevent suffering, and with humane care and treatment.

 

            B.         No person shall beat, torment, overload, overwork or otherwise abuse an animal.

 

            C.         No person shall own, keep, harbor, or otherwise maintain within the County, any breeds of fowl that are or will be used in the pursuit of and staging of cockfighting on any premises.

 

            D.        No person shall promote, stage, hold, manage, conduct, or carry on any animal fight or any other type of contest, game, or fight of a similar nature, nor any simulated version of same that involves baiting or inciting an animal toward intent to fight.

 

            E.         No person shall hold a greased pig contest.

            F.         No person shall be permitted to keep animals in violation of the "Illinois Humane Care for Animal Act (510 ILCS 70/1 et seq.) or the "Illinois Animal Welfare Act" (225 ILCS 605/1 et seq.).

 

            G.         No owner may abandon any animal where it may become a public charge or may suffer injury, hunger or exposure.

 

            H.        No person shall keep any animal within a building or upon any premises without food, water, or proper care and attention for a period of time sufficient to cause undue discomfort or suffering. If the owner cannot be located after reasonable search, or if the owner shall be known to be absent due to injury, illness, incarceration or other involuntary circumstances, it shall be the duty of the Administrator or a Humane Investigator to act upon the complaint as directed by the "Illinois Humane Care for Animals Act".

 

            I.          No person shall give away or use any live animal as a prize for or as an inducement to enter any contest, game, or other competition or as an inducement to enter a place of amusement or offer such animal as an incentive to enter any business agreement whereby the offer was for the purpose of attracting trade.

 

            J.          No person shall bring or cause to have brought into the County, sell, offer for sale, barter or display living baby chicks, ducklings or other fowl or rabbits which have been dyed, colored or otherwise treated so as to impart to them an artificial color, or give away as pets or sell, offer for sale, barter or give away at no cost or as novelties or prizes.  Nothing in this section shall be construed to prohibit legitimate commerce in poultry for agricultural or food purposes.

 

            K.        No person may knowingly poison or cause to be poisoned any domesticated animal.  The only exception will be written permit from the Illinois Department of Agriculture for the purpose of controlling diseases transmissible to humans or other animals and only when all other methods and means have been exhausted.  Such a permit shall name a person or persons conducting the poisoning, specify the products to be used, give the boundaries of the area involved and specify the precautionary measures to be employed to insure the safety of humans and other animals.  Any drugs used for euthanasia shall be by or under the direction of a licensed veterinarian.

 

            L.         No person shall kill or wound, attempt to kill or wound, or take the nest or eggs or young of any bird that is protected by Federal or State Law.  Birds that are regulated by the Illinois Department of Conservation are excluded from this restriction during the period of regulation.

 

            M.        No person shall keep or permit to be kept or display for exhibition purposes any wild animal contrary to Federal, State and Local laws or regulations.

 

            N.        No person shall permit at any time his animal to:

 

                        1.         Run uncontrolled;

 

                        2.         Molest persons or vehicles by chasing, barking or biting;

 

                        3.         Attack other animals;

 

                        4.         Damage property other than the owner's; or

 

                        5.         Bark, whine, howl or make excess noises so as to cause a nuisance.

 

            O.        No person shall allow animal feces to accumulate in any yard, pen or premises in or upon which an animal shall be confined or kept so that it becomes offensive to those residing in the vicinity or a health hazard to the residing animal.

 

            P.         No person shall fail to remove feces deposited by his animal, except guide dogs service animals, upon the public ways or within the public places of the County or upon the premises of any person other than the owner without that person’s consent.

            Q.        No person shall leave any animal unattended in a motor vehicle or enclosed trailer when the outside temperature shall exceed 30 degrees Celsius (86 degrees Fahrenheit) or contain any animal in such manner that said animal does not have proper air circulation while confined in a motor vehicle, trailer, kennel, dog house, or any type of container or structure in which an animal may be confined.

 

            R.         No person shall own any animal which is known to be infected with any disease transmissible to other animals or man, including severe parasitism, unless such animal shall be confined in such a manner as not to expose other animals or man.

 

            S.         Any animal which is on any public way or public place and which appears to be injured or severely diseased and for which care is not being provided on the scene by the owner or any injured or severely diseased animal that has strayed onto private premises shall be removed, if possible, to the care of the Cook County Department of Animal and Rabies Control, to the nearest humane society, to the nearest municipal pound, or to the nearest veterinarian or veterinary hospital willing to accept same without guarantee of payment.  If immediate removal shall not appear practical or possible or if the removed animal is in critical condition such animal may be deprived of life by the most humane method available on the scene unless the owner shall come forward beforehand and assume responsibility for immediate removal and care.

 

            T.         Any person who, as the operator of a motor vehicle, strikes an animal shall stop at once and render such assistance as may be possible; or shall immediately report such injury to the animal owner, if known; or the appropriate law enforcement agency; or to the local humane society.

 

            U.        Any person having a dead animal within his possession or control or upon any premises owned or occupied by such person without the proper permit shall dispose of the dead animal in compliance with the Illinois Dead Animal Disposal Act (225 ILCS 610/1 et seq.).

 

            V.        Every person in possession or control of any stable or place open for public use where any animals are kept, shall maintain the stable or place at all times in a clean, sanitary condition and conform to Illinois fire prevention regulations.

 

SECTION 3:

 

Rabies Vaccination

 

20.4.    A.        Every owner, except animal shelters, animal shelters, animal impounding facilities, and laboratory animal facilities, of an animal four months or more of age shall cause such animal to be inoculated with rabies vaccine by a licensed veterinarian at such intervals as approved by the Illinois Department of Agriculture.  The rabies vaccine shall be licensed by the United States Department of Agriculture and approved by the Illinois Department of Agriculture.

 

            B.         Evidence of such rabies inoculation shall be entered on a certified approved by the Cook County Board of Commissioners.  Veterinarians who inoculate an animal shall procure from the Cook County Department of Animal and Rabies Control serially numbered tags, one to be issued with each inoculation certificate.  Only one animal shall be included on each certificate.  Upon change of ownership application shall be made for a new inoculation certificate.  Such tags shall be attached to the collar or harness worn by the animal for which the tag was issued when the animal is off the property of the owner.  The cost of the tags shall be $4 $6 for a one-year tag and $12 $18 for a three-year tag.  The tag fees shall be paid to the Department and transferred to the County Treasurer on the last day of each month.

20.7.    A.        Whenever an Animal Control Warden observes or is informed that an animal is a stray or is roaming freely running at large and not under the control of the owner, the animal shall be immediately apprehended and impounded.  Any person may apprehend a stray animal and inform the local police or the Administrator so that the stray animal can be impounded.  Stray animals impounded by the Department of Animal and Rabies Control shall be kept at a location closest to the point at which the stray animal is apprehended.  A minimum of two impoundment locations shall be used by the Department, one optimally convenient to that portion of Cook County outside the City of Chicago lying north of the Eisenhower Expressway and one optimally convenient to that portion of Cook County outside the City of Chicago lying south of the Eisenhower Expressway.

 

            B.         All stray animals impounded shall have a record.  The record shall include the owner's name, address and telephone number, if known; species or breed, color, sex, and physical condition of the animal; license or tag number, if known; and the time and date impounded.

 

            C.         When owners of stray animals impounded are known, notice shall be given by mail to the last known address.  Stray animals shall be held not less than seven days, if the owner is known.  All unclaimed apprehended animals shall be placed for adoption, humanely euthanized or otherwise disposed of in accordance with the Illinois State Law.

 

            D.        The stray animal owner is responsible for all costs relating to the apprehension and impoundment of the animal found not under control.

 

SECTION 5:

 

Restrictions on Controlled Animals

 

20-8.    A.        Animals shall not be permitted to enter any place where food is processed for human consumption.  Guide dogs Service animals and guard dogs used in food establishments are exempt from this restriction.

 

            B.         Animals, except guide dogs service animals, shall not be present at or upon any school premises, public playground or public swimming pool unless official written permission has been granted by the public agency or its agent owning the property.  At no time shall animals be permitted in any sand box or sand piles in which children play.

 

SECTION 6:

 

Administrator Authority – Dog Parks or Areas

 

20-15.              No person including a municipal corporation, forest preserve district or park district shall designate within the County any outdoor area, even if fenced, as an area where dogs may run off leash unless such person, municipal corporation, forest preserve district or park district complies with such regulations as may be issued by the Administrator for the operation of outdoor off leash areas.

 

Supervision by Department-Rules and Regulations

 

20-1516. The Administrator may issue regulations, consistent with the provisions of this ordinance, for their administration and enforcement, and may prescribe forms which shall be used in connection therewith.

WHEREAS, the Clerk of Cook County maintains the Cook County permanent real estate index numbering system maps (“ Tax Maps”) representing all parcels in Cook County for the purposes of real estate taxation; and,

 

WHEREAS, these Tax Maps, previously maintained on mylar transparencies, are now being updated and maintained by County Clerk staff in a computerized format, through the tools provided by the County Geographic Information System; and

 

WHEREAS, the County Board in Ordinance 91-O-59 provided for a fee for photographing the mylars so that they could be made available to the public and commercial users interested in copying the mylars; and

 

WHEREAS, the mylars are being replaced by an imaged set of Tax Maps, which contain exactly the same information previously available to commercial users in the form of the mylar transparencies; and

 

WHEREAS, the imaged County Tax Maps are a “read-only” picture of the County Tax Maps in a digital format and do not represent the fully accessible Geographic Information System still under development by the County; and

 

WHEREAS, the Cook County Board of Commissions desires to establish fair and reasonable access to the complete set of Tax Maps in an imaged “read-only” digital format for commercial users who no longer will have access to the mylars; and

 

WHEREAS, the County asserts copyright protection for the Imaged Cook County Tax Maps.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF COOK, as follows:

 

Section 1.  Definitions:  The following terms used in this ordinance shall have the meanings set forth below:

 

            a.  Imaged Cook County Tax Maps”: means a “read-only” copy of an imaged set of the complete County Tax Maps as finalized by the County Clerk for a particular tax year and depicting the boundaries of all parcels for that year.

 

            b. read-only”: means the product can be viewed but not changed or altered.

 

            c. commercial user” means any person seeking County real estate tax maps for the purpose of furthering a commercial enterprise.

 

Section 2.  The Imaged Cook County Tax Maps shall be made available at the Base fee of $30,000.00 for each set for the particular tax year available at the time of the request, payable in advance by cash, money order or certified or cashier’s check made payable to the Clerk of Cook County.

 

Section 3.  The Office of the Cook County Clerk may provide the imaged copy of the County Tax Maps in any commonly accepted digital format and medium, as selected by the County Clerk

 

Section 4.  The Cook County Clerk shall include language in any Imaged Cook County Tax Map application whereby the applicant agrees that the Tax Maps are subject to the County copyright and that re-sale, transfer, copying and/or use by other than the applicant is prohibited and subject to penalties provided by law.

 

Section 5.  Notwithstanding the prohibitions stated in Section 4, an applicant may apply for and the County Clerk may issue a non-exclusive license allowing the applicant to re-sell, transfer, copy and otherwise use the Imaged Cook County Tax Maps.  An Additional license fee is imposed in the amount of five (5 %) percent of the gross receipts received by the applicant from any such re-sale, copy, transfer or other use of the Imaged Cook County Tax Maps. An applicant who paid the Base fee shall be entitled to a maximum credit of $20,000.00 against any liability for the Additional fee.

 

Section 6.  It shall be the duty of the County Clerk to collect and receive for the County’s general fund the license fees imposed by this ordinance.  The County Clerk shall adopt, promulgate and enforce rules and regulations not inconsistent with this ordinance relating to the administration and enforcement of the provisions of this ordinance. Such rules and regulations shall be consistent with the provisions of this ordinance designed to promote fairness. The Cook County Auditor is hereby authorized to examine the books, papers and records of any licensee during regular business hours in order to ascertain the license fee imposed by this ordinance.

 

Section 7.  This ordinance shall be effective upon its passage by the Cook County Board of Commissioners.

WHEREAS, Tax Maps of the County have been available for sale at the rate of $1.00 per page, for either the entire County overview or a single page of the Tax Maps; and

 

WHEREAS, advances in technology now make it possible for the Clerk to produce these maps in-house; and

 

WHEREAS, the Cook County Board of Commissions desires to establish fair and reasonable fees for these documents that are compatible with other fees charged by the county and that will cover the costs of materials and services.

 

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF COOK, as follows:

 

Section 1.  Definitions:  The following terms used in this ordinance shall have the meanings set forth below:

 

            a.   “map of Cook County” means an overview map, approximately 20” x 25” depicting Cook County with boundaries of the political townships and other features; and

 

            b.   “Tax Map page” means a single page of the real estate tax map books, that represents 80 acres of land and shows the parcel boundaries and property index numbers as used for real estate taxation purposes.  Tax Map pages may be laser printed or photocopied in 8 ½" x 11" or 11"x 17" formats.

 

Section 2.  The following fees shall be charged:

 

            a.   map of Cook County:  shall be provided for a fee of $10.00

 

b.       Tax Map page:  shall be provided for payment of a fee of $5.00

 

Section 3.  The County Clerk shall inscribe on each map produced in-house a reference to the County copyright.

 

Section 4.  This ordinance shall be effective upon its passage by the Cook County Board of Commissioners.

WHEREAS, as demonstrated by the Regional Transportation Authority (RTA) Board at its September 10, 2004 adoption of alternative statutory funding ordinances commencing the 2005 budget process for the RTA and its service boards, Chicago Transit Authority (CTA), PACE and METRA, existing funding services and mechanisms do not provide adequate resources to maintain current transportation services; and

 

WHEREAS, appropriate legislative action is required to give effect to the RTA resolution and service Board alternative budget resolutions.

 

NOW, THEREFORE, IT BE RESOLVED, that the Cook County Board be on record as supporting Ordinances, adopted by the RTA Board September 10, 2004 and budget resolutions implementing this resolution adopted by CTA, PACE and METRA; and

WHEREAS, pursuant to said agreement Sidwell provided printed copies each year of the mylars updated by the Clerk that year, for a fee of $100 annually; and

 

WHEREAS, the mylars covered by the agreement are no longer being updated and no longer need to be printed; and

 

WHEREAS, the agreement provided for termination upon thirty days notice by either party.

 

NOW THEREFORE BE IT RESOLVED, by the Members of the Board of Commissioners of Cook County, Illinois, on behalf of the County of Cook, that the CONTRACT WITH THE COUNTY OF COOK, made November 18, 1959 by the County Clerk, Cook County, State of Illinois and Sidwell Studio, Inc.
