Submitting the ordinance introduced to the City Council on October 1, 2003 that will be presented to the City’s Housing and Real Estate Committee on October 28, 2003, requesting that the Cook County Board of Commissioners enter no cash bids on behalf of the City of Chicago for parcels in the 2003 Scavenger Sale. Passage of the ordinance is anticipated at the November 5, 2003 City Council meeting. The City of Chicago would like to have a resolution confirming the City’s participation in the sale introduced to the Board of Commissioners at the meeting on November 4, 2003 and referred to the Committee on Finance Tax Delinquency Subcommittee.
The list of properties, while preliminary and likely to be smaller at certification, represents an enormous opportunity to put blighted and tax delinquent property back into productive use to the benefit of our communities and the taxpayers of Cook County.

The purpose of this letter is to inform you of the Village of Dolton’s desire to participate in the Cook County No Cash Bid program. The Village is interested in acquiring submitted parcels. All of these properties are located within the Village’s boundaries and are delinquent in real estate taxes or special assessments for two or more years, pursuant 35 ILCS 200/90.
Please accept this request to obtain these properties in Dolton, Illinois. The Village intends to acquire these properties for future redevelopment. There are no third-party applicants.
As part of this request, I have submitted all the information that is required by the Cook County Board of Commissioners to enable the Village to participate in this program. Also, the Village retained the legal services of Flamm & Teibloom, Ltd., to proceed to a tax deed and perform all other legal activities associated with this program.

Re: Montalbano v. Cook County, Case No. 03-CH-4707
Submitted herewith is a copy of Judge Siebel’s October 29, 2003 Memorandum Opinion entered in the above captioned cause.
In light of the recent change in the law that holds that the County Board acts in an administrative capacity when deciding to grant or deny a special use application, Judge Siebel has remanded this matter back to the County Board with direction that the matter be referred back to the Zoning Board of Appeals (ZBA) with instruction that the ZBA receive and review the County Building and Zoning (B&Z) Department and County Highway Department reports and issue supplemental findings and recommendation.
The County Board is then directed to examine the B&Z and Highway Department reports as well as the ZBA supplemental report and:
a) Approve the ZBA recommendation, in which case the County Board need only adopt the ZBA findings of fact; or
b) Reject any of the ZBA’s findings or recommendation, in which case the County Board is then directed to interact with the ZBA and examine the transcripts and evidence and issue findings of fact and render a decision revealing the grounds thereof.
The court had directed that the County Board and ZBA proceed expeditiously to avoid undue prejudice to the property owner and has set this matter for status on December 30, 2003.

WHEREAS, James O'Rourke began his career with the Clerk of the Circuit Court's Office, he was assigned to the Law Division in 1973 and worked there until 1981; and
WHEREAS, James O'Rourke became an Assistant Cook County Public Defender in 1981 and practiced law in nearly every Criminal Court in Cook County as a Public Defender, including five years as a First Chair in the Criminal Division at 16th and California; and
WHEREAS, in 1986, James O'Rourke was appointed Supervisor in the Public Defender's Office; and
WHEREAS, in 1989, James O'Rourke was appointed Executive Director of the Cook County Judicial Advisory Council by then Cook County Board President George Dunne, he continued in this capacity throughout the tenure of former Cook County Board President Richard Phelan and was reappointed to this position by Cook County Board President John H. Stroger, Jr. in 1994; and
WHEREAS, beginning in 1989, James O'Rourke started working on a wide variety of issues affecting Cook County's judicial system. Challenges such as jail crowding, the Juvenile Temporary Detention Center crowding, unfunded mandates, and coordination of the largest court system in American were successfully addressed during his tenure; and
WHEREAS, James O'Rourke obtained, on behalf of Cook County, over $100 million in grants and earmarked appropriations to provide needed revenue and equitable funding for Cook County's judicial system; and
WHEREAS, James O'Rourke created PROJECT BADGE with federal funds to provide a countywide crime prevention program for Cook County. PROJECT BADGE operates in 35 suburbs in Cook County and has helped over one hundred thousand at risk youth lead crime free productive lives; and
WHEREAS, James O'Rourke has worked with Judicial Advisory Council Chairman, William R. Quinlan, to provide advice and implement progressive policies which have helped to improve nearly all aspects of Cook County's judicial system.
NOW, THEREFORE, BE IT RESOLVED, that I, John H. Stroger, Jr., along with the Cook County Board of Commissioners, do hereby congratulate James O'Rourke for his many years of exemplary service and send "best wishes" for good health, happiness and continued success in all of his future endeavors.

PROPOSED ORDINANCE AMENDMENT
AN ORDINANCE DIRECTING THE PURCHASING AGENT TO USE INNOVATIVE MEANS OF PROCUREMENT INCLUDING ONLINE BID NOTIFICATION AND ONLINE BIDDING
WHEREAS, it is the goal of the Cook County Purchasing Agent to procure quality goods and services for the County at the lowest cost; and

WHEREAS, electronic communication such as email and internet sites create a way to reach more potential bidders; and
WHEREAS, the more bidders that are aware of contract possibilities, the greater the potential for cost savings to the County because of increased competition; and
WHEREAS, soliciting bids via the internet and email allows smaller businesses, which are often minority and women owned, to access information more easily, giving them greater access to government contracts; and
WHEREAS, there is a positive environmental impact because when online purchasing measures are used there is a reduction in the use of paper; and
WHEREAS, using online posting, bidding and emailing creates faster transactions, cost savings and a more open and fair process.
NOW, THEREFORE, BE IT ORDAINED,
Section 1. That Sections 10-18 and 10-43.6 are amended and add Section 10-18.1
The purpose of this ordinance is to encourage the purchasing agent to use innovative means of purchasing in order to increase participation in the bidding process and decrease costs.
10.18. Equipment Purchase Procedure. The purchases of and contracts for supplies, materials, equipment, and contractual services and all sales of personal property which has become obsolete or unusable shall be based on competitive bids. If the amount involved is estimated to exceed $25,000, sealed bids shall be solicited by public notice inserted at least once in a newspaper of county-wide circulation, and by posting notices on an internet-based system, and at least five calendar days before the final date of submitting bids. Such notices shall include a general description of the commodities or contractual services to be purchased or personal property to be sold and shall state where all blanks and specifications may be obtained and the time and place for the opening of bids. The County Purchasing Agent may also solicit sealed bids by sending requests by mail or electronic communication to prospective suppliers and by posting notices on a public bulletin board in his office. All purchases of $25,000 or less may be made in the open market without publication in a newspaper as above provided but whenever practical shall be based on at least three competitive bids. No purchases, orders or contracts of $25,000 or more shall be made unless authorized by the Board of Commissioners. All sales of obsolete or unusable material shall be made to the highest responsible bidder. Whenever the Board of Standardization hereinafter provided for shall have prescribed standard specifications, bids on purchases of supplies, materials, and equipment shall be based on such standard specifications. All purchases, orders, or contracts shall be awarded to the lowest responsible bidder, taking into consideration the qualities of the articles supplied, their conformity with the specifications, their suitability to the requirements of the county and the delivery terms. In the determination of the award to the lowest responsible bidder, nothing herein shall be interpreted to preclude an award to a bidder other than the lowest actual bidder if such an award is made in furtherance of nondiscriminatory hiring practices and equal employment opportunity. Provided, however, that the award of all contracts shall be responsible and reasonable. Any bid may be rejected and new bids may be solicited if the public interest is served thereby. Each bid, with the name of the bidder, shall be entered on a record, which record with the successful bid indicated thereon shall, after the award of the purchase or order or contract, be open to public inspection. A copy of all contracts shall be filed with the County Comptroller and with the County Purchasing Agent. 10-18.1 The County Purchasing Agent may perform the functions described in paragraph 10-18 above using innovative means of procurement including, but not limited to, electronic procurement, reverse auctions, electronic bidding, electronic auctions, procurement cards and any other means the Purchasing Agent deems to be competitive and in the best interest of the County. The Purchasing Agent shall establish appropriate requirements, criteria and procedures to implement these procurement methods.
10-43.6(C) Review of Bid or Offer. (c) Advertise, not less than 15 calendar days before the bid opening date, in one or more daily newspapers and/or trade publications, through electronic communications, or internet-based systems, for bids by PCEs for subcontracts or the supply of goods and services on the contract.
