ORDINANCE

AN ORDINANCE TO DEFRAY THE COST OF IMPLEMENTING AND MAINTAINING

COOK COUNTY’S GEOGRAPHIC INFORMATION SYSTEM

 

            WHEREAS, the County of Cook is a home rule unit of local government pursuant to Article VII, Section 6 of the 1970 Illinois Constitution and may exercise any power and perform any function pertaining to its government and affairs; and

 

WHEREAS, the County of Cook, under the guidance of the Cook County Assessor, has created a countywide map using a Geographic Information System (GIS) which was of considerable cost to the County to create and is of considerable cost to maintain; and

 

            WHEREAS, the Illinois Compiled Statutes, 55 ILCS 5/3-5018, governs fees charged by recorders in counties of the first and second classes and authorizes the county board of any county that provides and maintains a countywide map through a geographic system to impose an additional charge of $3.00 for the filing of every instrument, paper, or notice for record in order to defray the cost of implementing or maintaining the county’s geographic information system; and

 

WHEREAS, the County Board is desirous of imposing an additional charge for the filing of every instrument, paper, or notice of record with the Cook County Recorder’s Office in order to implement the above statute.

 

            NOW, THEREFORE, BE IT ORDAINED, by the Board of Commissioners of the County of Cook as follows:

 

1.                   Definitions:  The terms used in this ordinance shall have the meanings set forth below:

 

a.       countywide map” is a parcel based map of Cook County which includes all the supporting Geographic Information System.

 

b.       geographic information system” is an organized collection of computer hardware, software, and geographic data designed to efficiently capture, store, update, manipulate, analyze, and display all forms of geographically referenced information.

 

c.       additional charge” is a $3.00 charge which is added to the existing fees imposed by the Cook County Recorder for the filing of every instrument, paper, or notice of record.

 

2.                   Implementation:

 

The $3.00 charge will be distributed as follows:

 

a.   $2.00 will be deposited into a distinct fund set up by the Cook County Bureau of Information Technology and Automation.  These monies will be used solely to finance equipment, materials, and other necessary expenses incurred in implementing and maintaining a geographic information system.

 

b.   $1.00 will be deposited by the Recorder pursuant to 55 ILCS 5/3-5005.4, “Deposit of Fee


Income-Special Funds.”

 

3.       This ordinance shall be effective 30 days after approval.

ORDINANCE

AN ORDINANCE AUTHORIZING TRANSFER OF REAL ESTATE

FROM THE COUNTY OF COOK TO THE TOWNSHIP OF PALATINE

 

WHEREAS, the County of Cook, a body politic and corporate of the State of Illinois (the “County”), is the owner of certain real estate commonly known as Sutherland Cemetery and legally described on Exhibit A submitted hereto and made a part hereof, located in the Township of Palatine, Cook County, Illinois; and

 

WHEREAS, the Township of Palatine, a political subdivision of the State of Illinois, desires to obtain title to the Real Estate for the public purposes of maintaining the cemetery and improving the Real Estate to the extent permitted by law; and

 

WHEREAS, the provisions of Article VII, Section 10 of the 1970 Constitution and the provisions of the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq. authorize and encourage the intergovernmental cooperation set forth in this Agreement; and

 

WHEREAS, pursuant to the Local Government Property Transfer Act, 50 ILCS 605/0.01 et seq., the Township has duly adopted a Resolution, a copy of which is submitted hereto as Exhibit B which declares that it is necessary or convenient for the Township to use, occupy or improve the Real Estate for the aforementioned public purposes and the Resolution further declares that the Township is authorized by law to receive title to the Real Estate and will accept any transfer of title to the Real Estate made by the County to the Township; and

 

WHEREAS, the Director of Real Estate and Property Management for the County (the “Director of Real Estate Management”) has advised the Board of Commissioners of Cook County (the “Cook County Board”), and the Cook County Board so agrees, that the Real Estate is not essential for County purposes, so long as the cemetery is maintained as required by law by the Township; and

 

WHEREAS, the County is desirous that the cemetery be maintained as required by law and that the Real Estate be maintained as public open space by the Township and therefore the County will not require an appraisal of the Real Estate as a condition of conveyance, if any; and

 

WHEREAS, the Cook County Board adopts this Ordinance, by a vote of two-thirds or more of its members, which Ordinance authorizes the conveyance of the Real Estate to the Township of Palatine for nominal consideration, pursuant to its home rule and statutory authority, including the Local Government Property Transfer Act, 50 ILCS 605/0.01 et. seq.

 

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF COOK COUNTY, ILLINOIS AS FOLLOWS:

 

Section 1:           The foregoing recitals are incorporated herein as findings of the Board of Commissioners of Cook County, Illinois.

 

Section 2:           The President of the Cook County Board of Commissioners is hereby authorized to execute on behalf of the County of Cook, a Quit Claim Deed, in the form submitted hereto and incorporated herein as Exhibit C, conveying the Real Estate to the Township of Palatine, subject to the covenants, conditions and restrictions contained therein, which Quit Claim Deed shall be attested and delivered by the appropriate County officials.


 

Section 3:           The President of the Cook County Board of Commissioners and the Cook County Comptroller, or the Director of Real Estate Management, are hereby authorized to execute and deliver any and all other documents or instruments and take any and all steps necessary or desirable to effectuate such conveyance.

 

Section 4:           This Ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law.
